ORDER Contention 23 in this proceeding / was originally tendered as CASE 1
Contention 9 and ACORN Contention 25. These two contentions were modified and combined by the Board,SI and the modified contention was admitted as No. 23.5/ ACORN was subsequently designated the lead party intervenor for Contention 23.A/
ACORN later filed a motion for its voluntary dismissal from this proceeding, which was granted by our Memorandum and Order issued July 24, 1981. That Order also designated CASE as the successor lead party on 1/ either the Applicants nor the Staff has adequately considered the health Neffects of low-level radiation on the population surrounding CPSES in as much that the CPSES design does not assore that radiation emissions will be as low as is reasonably achievable.

.= Contention 23, but asked that the Board be advised if CASE was unwilling to lead on that contention (Order, p. 3).
Pursuant to the Board's request, CASE on August 10, 1981 filed its notice of withdrawal from Contention 23.
It had previously indicated its intention to withdraw in the December 1,1980 Supplement to CASE's Answers to Applicants' First Set of Interrogatories. Accordingly, Contention 23 is hereby stricken from the contentions in this proceeding It is so ORDERED.
