Dear Mrs. Young:
This is in response to your letter of July 10,1981 to Mr. Bemard J.
Snyder which expressed your concems about the possible restart of THI-1.
As you undoubtedly know, the hearing ordered by the Commission in its Order of August 9,1979 to detemine whether any further operation of Till-1 will be pemitted and, if so, under what conditions, has been completed. The Comission's final decision will be made 35 days after the hearing Board issues its initial decision.
The August 9.. Order contains a list of both short-and long-tem actions recommended by the Director of Nuclear Reactor Regulation (Mr. Denton) to be required of the licensee to msolve the Comission's concerns and pemit a finding of reasonable assurance that the facility can safely resume operation. During the proceedings, other items were added by the staff. The staff has concluded that with the exception of one long-tem iten which is still in dispute but is expected to be resolved shortly, the licensee is in compliance with the requirements of the Order and Ti1I-l can safely resume operations without undue risk to the public health and safety, subject to verification of installation of modifi-cations and corpletion of all mquired tests.
The hearing Board in its initial decision may of course modify the list of recoamended actions and the Comission will decide what actions are necessary and sufficient to provide reasonable assurance that the TMI-1 facility can be operated without endangering the health and safety of the public, and should be required of the licensee. Certification of final completion of all required actions is to be made to the Comission by the Director of Nuclear Reactor Regulation.
The location of TMI-l was not in itself a matter defined by the Commission to be heard in tM TMI-l restart proceedings. However, safe design of the plant and effective emergency preparedness ransidering the oca-tion were specifically and extensively discusses..
