By letter dated April 11, 1994, your predecessor as Chairman of the ACRS, l

J. Ernest Wilkins, Jr., transmitted the Advisory Committee on Reactor Safeguards views on the issue of expanded input in advisory committee selections. To the extent possible, we attempted to incorporate these views in the final Commission guidance to the staff on this subject, which is enclosed.

Although we had hoped to have members from the advisory committees serve on the screening panel, the Office of General Counsel has informed the Commission that inclusion of individuals who are not full-time Federal employees on the panel would require that the screening panel be established as an advisory committee under the Federal Advisory Committee Act.

Establishment of the panel as a Federal advisory committee would be in conflict with the Administration's direction to Federal agencies to limit the establishment of new advisory committees.

Consequently, the Commission has decided to restrict panel membership to full-time Federal employees. We have, however, striven to incorporate active advisory committee participation into the process by providing a mechanism for the advisory committee to make selection recommenda-tions and by having a full-time advisory committee staff representative on the screening panel. We believe that candidates having the technical expertise, breadth of experience and knowledge, and professional stature d,esired can be selected by using this plan.

We will evaluate the effectiveness of these procedures after a two-year period.
