SUBJECT:
PUBLIC DISCLOSURE DETERMINATION (TAC NO. L21653)
This is in response to your letter and affidavit dated March 31, 1994 requesting that the financial statements enclosed pertaining to the financial assurance for decommissioning be withheld from public disclosure pursuant to 10 CFR 2.790(a)(4) of the Commission's regulations.
In the affidavit Mr. Edwards states that the submitted information should be withheld from public disclosure for the following reasons:
The subject documents constitute confidential financial information of a privately-held corporation which has been held ir confidence by the owner and are customarily held in such confidence, and are not available in public sources.
Public disclosure would create substantial harm to the owner by providing detailed financial information to its competitors and other parties whose interest may be adverse to the owner.
On the basis of your submittal, our review of the above documents, and in light of the requirements of 10 CFR 2.790, we have determined that the above submittal should be withheld from public disclosure pursuant to 10 CFR 2.'/90.

Withholding from public inspection shall not affect the right, if any, of per'ons properly and directly concerned to inspect the documents as provided for in 10 CFR 2.790(b)(6).
If, at any time in the future, the basis provided in your submittal for withholding information from public disclosure should change such that the information could then be made available for public inspection, General Atomics should promptly notify the Nuclear Regulatory Commission.
General Atomics should also he aware that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information.
In all review situations, if the NRC makes a determination adverse to the above, General Atomics will be notified in advance of any public disclosure.
