Dear Mr. Gavensky:

I am writing to acknowledge receipt of your Petition of March 3, '1994, to the U.S. Nuclear Regulatory Commission (NRC) pursuant to 10 CFR 2.206..The petition has been referred to my office for preparation of a response.

In the Petition, y-

'ise numerous concerns regarding receipt inspection activities by North u Utilities at the Haddam Neck Plant'and Millstone haclear Power Station, Units 1, 2, and 3.

Your Petition' alleges violations of 10 CFR Part 50, Appendix B, by Northeast Utilities'in the receipt ins'pection area.

iiic Petition alleges that parts represented as having been inspected and accepted for use were in fact defici.ent. The Petition alleges that adequate training, skilled personnel, and necessary tools were not available to perform adequate receipt inspections.

The Petition alleges that you observed unethical and tricorrect methods of receipt inspection, and that you sought to identify quality problems within your own departmente along with recommendations and solutions, but y the Petition accuses Northeast Utili.ou were not permitted to do so.

Finally, ties of " white washing" your concerns in the receipt inspection area. The Petition alleges that, on two occasions, Northeast Utilities' management hiv vestigators to pursue concerns raised by you only to conclude that ther o problems.

On one of the occasions of allege washing," you claim that you came to the NRC with your complaint and you esent in the Petition that the NRC substantiated your complaint. This review was documented in NRC Inspection Reports 50-423/92-16 and 50-423/92-24 provided to you by letter of March 30, 1993.

NRC Inspection Report 50-423/92-16 discusses the issue of receipt inspection of bolts purchased by Stone and Webster Engineering Corporation (SWEC) and that important attributes for visual inspection were not included in inspections. The NRC inspection report indicated that an independent review of this issue was performed by an Independent Review Team (IRT) commissioned by the Northeast Utilities' Nuclear Safety Concerns Program.

The IRT's initial review concluded that Northeast Utilit sys' oversight of the SWEC's quality assurance program was satisfactory withcut determining how the nonconforming fasteners were accepted and placed in stock and whether a programmatic problem existed which allowed the acceptance of the discrepant fasteners.

Northeast Utilities' subsequent followup involved testing representative samples of the fasteners and revisiting SWEC's program for

establishing purchase order and receipt inspection requirements.

3 Mr. Ronald Gavensky May 9, 1994 except one had acceptable test results, but that the nonconforming conditions, including some visual deficiencies, would not have adversely affected the ability of the fasteners to perform their function; and that Northeast Utilities' current receipt inspection program is deliberate and controlled.

Since there have been no unacceptable ~SWEC parts identified in use in the field, the NRC staff considered the issue resolved.

Your allegations regarding the lack of adequate training of personnel in receipt inspection, the lack of skilled personnel, necessary tools unavailable to perform adequate receipt inspection, and unethical and incorrect methods of receipt inspection being performed generally relate to activities occurring prior to 1983 through 1991. A limited NRC review of the. procurement program at Millstone was conducted in Decemberc1993 (see enclosed NRC Inspection Report 50-423/93-26).

The ccnclusions of that inspection found no significant safety issues. A followup review of the Northeast Utilities' receipt inspection program is proposed for the future to resolve the technical concerns that you have identified at both Millstone and Haddam Neck"in the areas of receipt inspector qualification, receipt inspection tools and prt adures, and receipt inspection deficiencies.

In your Petition, you request that' the" licenses"of" Northeast' Utilities be temporarily revoked until after the NRC conducts an investigation of your allegations. The NRC considers this a request-for"immediate~ action until such time as the concerns you raise are evaluated. As noted above, the Northeast Utilities' testing of samples of the bolting materials left' avert from Millstone, Unit 3 construction indicated that while visual deficiencies in the bolting materials were noted, none would have adversely affected the ability of the materials to perform their design function. As also noted above, NRC review did identify weaknesses in the 1987 receipt' inspection program-(i.e.,

Northeast Utilities' oversight of the SWEC Quality Assurance program, effectiveness of the SWEC receipt inspection program and Northeast Utilities' procedures for transferring left over construction material from Unit 3),

principally at Millstone, Unit 3, which have been corrected. Also, as noted above, the NRC performed an inspection of the Millstone procurement program in December 1993 and found no outstanding safety' issues. Thus we do not consider your issues to be immediate safety concerns and, therefore, do not warrant immediate shutdown of the Haddam Neck Plant and Millstone Nuclear Power Station, Units 1, 2, and 3.
