Dear Mr. Cramer:

This refers to your letter dated March 1,1994, notifying the NRC Region Ill l

Office of the loss of a portion of a polonium-210 static elimination device.

The device, Nuclestat Model P-2001, serial number SP29585, is manufactured by NRD, Inc., and contains a nominal 324 millicuries of polonium-210.

On January 8, 1994, the device was discovered damaged due to inadvertent shearing.

Followup of the event indicated that an eight inch portion of the device was missing. The missing portion is estimated to contain approximately nine millicuries of polonium-210.

Search efforts to recover the missing piece proved unsuccessful.

Your investigation concluded that the missing piece was inadvertently disposed of as ordinary waste at a local landfill.

After reviewing this incident, a violation of NRC requirements was identified.

The violation involves the unauthorized transfer of approximately nine millicuries of polonium-210, and is described in the enclosed Notice of Violation. A written response is required.

The NRC recognizes that the safety significance of this violation is minor i

given the small amount of material discarded.

Nonetheless, the violation i

demonstrates the importance of maintaining adequate control of all radioactive material to ensure that improper handling or disposal does not occur.

Therefore, although the violation has been classified at a Severity Level IV in accordance with the " General Statement of Policy and Procedure for NRC l

Enforcement Actions," 10 CFR Part 2, Appendix C, any similar violation in the future may result in additional enforcement action, including issuance of a j

civil penalty.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed Notice will be placed in the NRC Public Document Room.

The response directed by this letter and the accompanying Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
