Dear Mr. Joyner:
The purpose of this letter is to notify the Commission of recent changes related to management of the Buffalo Materials Research Center Reactor.
The University has decided not to award a follow-on contract to Materials Engineering Associates Inc. (MEA) to manage the reactor facility.
As a consequence, UB has re-assumed responsibility for management and operation of the reactor effective February 21, 1994.
Mr. Louis G.
Henry has resigned as General Manager of Buffalo Matcrials Research, Incorporated and has accepted employment with the University as Director of Research Facility Services.
Mr. David Vasbinder, formerly the BMRC Analytical Services Manager, has been appointed as Director of BMRC on an interim basis.
The transition from private management back to direct University operation is not addressed in the reactor license, and to our knowledge was not discussed with the Commission Staff when the amendment incorporating MEA into the Technical Specifications was issued in 1985.
It is our intention to effect this transition as smoothly as possible. ensuring continued safe operation of the reactor facility.
We welcome the opportunity to work with the Commission Staff to achieve this goal.
We further recognize the need to maintain continuity of the reactor staff and to ensure that the necessary resources to safely operate the reactor are maintained.
Mr. Henry will continue to have management responsibility for operation of the reactor facility.
This will parallel Mr. Mark Pierro's oversight role as Radiation Safety Officer.

4 i with the reactor staff and the senior managers of MEA to organize and effect the transition.
He will lead our effort to reorganize the Nuclear Safety Committee (NSC), and is regularly attending meetings of the Operating Committee (a sub-committee of the NSC).
In order to maintain continuity of the Emergency Planning and Preparedness programs, Mr. Pierro is now the designated Emergency Planning Officer.
Mr. Henry, in light of his experience, will remain on 24-hour call as a primary emergency responder, and will continue in an active role with the off-site emergency response organizations.
A meeting to discuss these changes, and more specifically the amendment of the license technical specifications to delete the private manager, MEA, would be helpful for all parties.

Henry will be contacting the Commission Staff to initiate such a meeting soon.

The purpose of this ictter is to infonn you of the fmal disposition of the alleged incident of operator 'non attentiveness" witichiccurred at the BufTalo Material Rescan:h Center (fiMRC)in November of 1992.
Effective October 21,1993 the individual inwhrd has accepted voluntary tmnsfer into an altemative Civil Service position In this new position he will remain assigned to the 13MRC and will perform technician duties substantially as he has for the last several months. IIe will no longer function as a licensed operator and will not manipulate the controls of the mnetor.
We believe that the remaining reactor opemtors have continued to perfuan in a responsible manner, and have been pmperly attentive to their duties.
I will notify Mr. Caldwell of the Operating Licensing staff, under separate cowr, that tids individuals license may be terminated effective immexliately.
