NRC Docke: Nos. 50424-OLA.-3, 50-425-OLA-3; License Amendment for Transfer to Southem Nuclear Operating Company Gentlemen:

On April 12,1994, the Licensing Board issued a Memorandum and Order (April 11 Status Conference Results) which requires, with one exception, that all dixovery related to ,

i the alleged illegal transfer of authority be completed by April 29,1994. The one exception is a dispute concerning certain questions Mr. Kohn asked Mr. Dahlberg during his deposition, which dispute is separately addressed in the Ibard's Onler.

Yesterday, the parties concluded the depositions which have been requested to date, with two exceptions (aside from the dispute concerning Mr. Dahlberg): (1) Mr. Kohn was unable to complete his questioning of Mr. Hairston in the two hours which the parties had previously agreed upon, and (2) Mr. Kohn declined to intetview Mr. Beckham at the time he l had been scheduled to appear (April 15th at 9:00 a.m.) because Mr. Kohn was conducting g5130053940506 g ADOCK 05000424  ;

In order to determine whether GPC will conduct any additional depositions prior to April 29,1994, counsel for GPC needs to know whether Intervenor will call any witnesses on the alleged illegal license transfer issue other than Messrs. Hobby and Mosbaugh.

'Iherefore, I propose that the parties exchange their lists of witnesses ort this issue by facumile on the evening of April 20th or the moming of April 21th, early enough so that each party will have an opportunity to assess the need for the telephonic status conference which is scheduled for April 21,1994, at 2:00 p.m.
