Dear Mr. Lightner:
This is to inform you that the U.S. Nuclear Regulatory Commission has reissued its draft technical position (TP) on alternate concentration limits (ACLs),
under the title " Draft Final Staff Technical Position on Alternate Concentration Limits for Title II Uranium Mills." The availability of the current draft was announced in the Federal Reaister (59 B 13345; March 21, 1994), with a 90-day comment period.
A copy is enclosed for your review and comment.
The current draft final TP on ACLs represents a revised and updated version of NRC staff draft TP, which was announced in the Federal Reaister on June 30, 1988, (53 8 24820).
The current draft incorporates all of the revisions that have been made based on comments received to date, including those received from the staff of the U.S. Department of Energy.
This TP provides guidance for preparing ACL applications by licensees of commercial uranium and thorium mill tailings sites, which are regulated by NRC under Title 11 of the Uranium Mill Tailings Radiation Control Act (UMTRCA),
and for review of such applications by NRC staff.
Specifically, the TP describes NRC requirements for instituting ACLs, the standard format and content of ACL applications, and application review criteria and procedures.
The NRC staff plans to review ACL applications for particular sites using this TP.
Please note that ACL applicants relying on a distant Point of Exposure, as defined in the TP, are required to secure a binding pre-determination of whether the State or Federal government will be the eventual site custodian, and an authoritative commitment from that party, that it will accept the transfer of the site, including land in excess of that used for disposal of byproduct material.
The same requirement will be imposed on ACL applicants choosing to keep the property under a specific NRC license, and applying for an ACL as part of a compliance monitoring program.
Unless such a commitment is secured by the licensee, to the satisfaction of the Commission, these ACL applications will not be approved. We would appreciate your commenting on these new provisions in the TP.
In addition, this issue may be of particular interest to the task force that we understand DOE has formed for UMTRCA Title 11 sites, mm"!. mn 0 0 3 0 41 gp 7 ',
