Routine Inspection No.94-004 On April 22, 1994, I conducted a routine safety inspection at a field site located in Milford, Connecticut, where your company was performing mdiography. At the time of the inspection, authority to perform this work by you as an Agreement State Licensee in a non-Agreement State was under recipmcity in accordance with the general license provided by 10 CFR 150.20. The inspection was an examination of your licensed activities as they relate to radiation safety and to compliance with the Commission's regulations and the license conditions. The inspection consisted of observations by the inspector, interviews with personnel, and a selective examination of representative records. The findings of the inspection were discussed with Mr.
William Carhart at the conclusion of the inspection and with Mr. Roger Soriano on April 25, 1994.
The inspection resulted in the identification of one violation of NRC requirements. The violation involved your conduct of work in a non-agreement state without first obtaining approval as required by 10 CFR 150.20(b)(1). Specifically, you initiated work at the Milford, Connecticut site on April 11, 1994, and continued to do work on a daily basis there, without first obtaining approval from the NRC. You did not obtain approval to start the work until April 19, 1994.
A Notice of Violation is enclosed as Appendix A and has been categorized at Severity Ixvel IV.
The " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy) categorizes this type of violation at Severity LevelIII. We have used our discretion and downgraded it to a Level IV violation because you previously notified us of the work location but did not provide the specific dates. Please be aware that further violations of this nature could lead to more serious enforcement action by the NRC. You are required to respond to this letter, and in preparing your response, you should follow the instructions in Appendix A.
Please use the enclosed self-addressed green envelope when you submit your copy to the Regional Administrator, Region I. This will assist us in the timely processing of your response.
