l During the period March 9-April 12,1994, Eric H. Reber, Gregory C. Smith and Penny l

Nessen of this office conducted a special safety inspection at your facilities at the l

Momingside Campus, Barnard College and Nevis Cyclotron I.aboratory of activities l

authorized by the above listed NRC license. The scope of this inspection is described in the l

enclosed inspection mport. The findings of the inspection were discussed with individuals indicated in the enclosed inspection report.

Based on the msults of this inspection, it appears that some of your activities were not conducted in full compliance with NRC requirements. A Notice of Violation (Notice) is enclosed as Appendix A and categorizes each violation by severity level in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (Enforcement Policy). You are required to respond to this letter and to the enclosed Notice and in preparing your response, you should follow the instructions in Appendix A.

Items A and C.1 in the Notice of Violation enclosed with this letter wem also identified during a previous inspection of your licensed activities and documented in a Notice of Violation enclosed with our letter dated July 14, 1993. From our current inspection, it appears that you failed to take corrective actions for those items identified previously.

Uncorrected violations are given additional weight in the consideration and selection of appropriate enforcement action. Therefore, in your response to this letter, you should give particular attention to those actions taken or planned to ensure that identified items of noncompliance will be corrected and will not recur.

Please use the enclosed self-addressed green envelope when you submit your response to the Regional Administrator, Region I. This will assist us in the ti.mely processing of your response.
