REQUEST FOR NEW ENVIRONMENTAL DATA COLLECTED UNDER THE CONSENT AGREEMENT WITH SOUTH CAROLINA DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL

Dear Ms. Spalding:

On October 28, 2019, the U.S. Nuclear Regulatory Commission (NRC) published a draft Environmental Assessment (EA) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19228A278) related to its review of Westinghouse Electric Company, LLCs (Westinghouses) application for license renewal of its Columbia Fuel Fabrication Facility in Hopkins, South Carolina. The issuance of the draft EA initiated a 30-day public comment period, which ended November 27, 2019. The NRC received comments from the South Carolina Department of Health and Environmental Control (SCDHEC) that requested the NRC either suspend making a final finding of no significant impact determination or extend the comment period for 120 days to allow time to receive, review, and evaluate new groundwater and sediment data (ADAMS Accession No. ML19344C158). By letter dated January 13, 2020 (ADAMS Accession No. ML20009F526), the NRC responded that the new data will be considered as part of the environmental review. Therefore, the NRC requests that Westinghouse submit the groundwater and sediment data, referenced in SCDHECs letter, to the NRC for review in accordance with 10 CFR 51.41, Requirement to submit environmental information, and 10 CFR 70.21, Filing.

The additional information requested should be provided within 30 days from the date of this letter. The NRC staff intends to issue additional requests for information to address other comments received from the public and external stakeholders. Revisions to the licensing schedule are needed to account for the review of the new data and the need for additional clarification from public comments received during the 30-day comment period on the draft EA.

The NRC will promptly communicate changes to the schedule after receiving the additional information requested.

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
