SUBJECT:

INSPECTION AT CHEVRON'S BUILDING C, LOCATED AT THE ENGELHARD CORPORATION FACILITY IN CLEVELAND, OHIO.

This refers to the special inspection and radiological survey conducted by Mr. Kenneth Lambert of this office on March 7, 1994 through March 28, 1994 of l

Building C, located on the Engelhard Corporation Facility at 1000 Harvard Avenue, Cleveland, Ohio.

Building C was one of the buildings which previously belonged to the Harshaw Chemical Company Complex, where natural uranium was processed. This survey was conducted in response to Chevron's inquiry regarding NRC's regulatory authority for this site. At the conclusion of the inspection on March 7, 1994, the preliminary results were discussed with you, your consultants, and Engelhard Corporation representatives.

The enclosed copy of our inspection report identifies the areas examined during the inspection. Within these areas, the inspection consisted of a selective examination of Department of Energy contractual records, i

observations, independent measurements, and interviews with personnel.

Based upon our inspection findings, residual radioactive materials were identified on buildings surfaces in numerous areas on all floors in excess of NRC's unrestricted use criteria. NRC's inspection findings have also determined that the building is secured and does not pose an immediate health and safety concern to Engelhard employees or members of the general public.

NRC's Office of the General Counsel and Division of Low Level Waste are currently reviewing the issue of NRC's regulatory authority for your site.

Therefore, we request that restricted access and security of the site be maintained until reguiatory authority has been determined.

In addition, we l

request that you notify NRC prior to initiating any remediation activities.

l In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed inspection report will be placed in the NRC Public Document Room.
