Request for Exemption from License, Inspection, and Annual Fee Requirements (10 CFR Parts 170 and 171)

Dear Ms. Bandois:

I am writing on behalf of the State University of New York at Buffalo, a nonprofit educational institution, to request an exemption from the above referenced annual fees amounting to

$66,340.

We believe there are compelling public interests and educational benefits which justify this request.

University reactors such as ours provide significant benefits to the public, the nuclear industry, and government.

These include the education and training of engineers, health physicists, and radiation scientists who occupy important positions in business, academia, and federal and state agencies, including the Department of Energy and the NRC itself.

At the University at Buffalo, our reactor is utilized extensively to conduct research in the areas of pressure vessel radiation embritlement and radiation enhanced corrosion cracking.

Much of this work has been sponsored by the NRC, and its results have appeared in NUREGS.

This has directly contributed to NRC's ability to establish acceptable operating parameters for nuclear power plants across the nation.

Our reactor staff supports research and education in the fields of biology, biochemistry, physics, toxicology, and art conservation.

We promote public and professional education programs in radiation safety and emergency response, and we facilitate public participation in the selection of a method and site for low level radioactive waste in the State of New York.

Nuclear Regulatory Commission November 16, 1993 Page 2 From November of 1989 to June of 1992,"our reactor was out of service to repair a leak in the reactor tank.

As a result of the extended shutdown we have experienced a significant increase in cost and erosion of the reactor's external base of research support.

The reactor is now operating at a significant deficit at a time when the University's operating budget itself has been under severe pressure for the past several years.

It is unlikely that additional funds to cover the proposed fees can be culled from an already austere University budget and reactor research programs would be in jeopardy.

The University appreciates your consideration of this request.
