SUBJECT:

FITNESS-FOR-DUTY INSPECTION AT THE CALLAWAY NUCLEAR POWER STATION

This refers to the inspection conducted by Mr. G. Pirtle of this office

between November 29 and December 30, 1993. The inspection included a review

of authorized activities for your Callaway Nuclear Power Station facility.

At the conclusion of the onsite inspection, the findings were discussed with

those members of your staff identified in the enclosed report.

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observations of

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements.

We carefully reviewed the issues in

your December 14, 1993 letter which included your staff's conclusion that a

violation of NRC requirements did not occur. We have decided to forward the

issue to the Office of General Counsel since the issue is one of legal

interpretation and generic applicability.

Pending completion of their review,

we are considering the matter to be unresolved.

Your staff was notified of

this by telephone on February 14, 1994.

We are also concerned that on two occasions unescorted access to the protected

area was granted before confirmation that all requirements _for such access was

completed,_as described in Section 6 of the Report Details. However, to

encourage self identification of problems, the access authorization

and therefore, a separate Notice of Violation will not be issue $
