Gentlemen:
SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-382/91-04)
This refers to the inspection conducted by Ms. Linda McLean of this office
during the period February 5-8, 1991. The inspection included a review of
activities authorized for your Waterford-3 f acility. At the conclusion of the
inspection, the findings were discussed with those members of your staff
identified in the enclosed report.
The area examined during the inspection was the implementation of your
fitness-for-duty (FFD) program. Within this area, the inspection consisted of
selective examination of procedures and representative records, interviews with
personnel, and observation of activities in progress.
Based upon the results of this inspection, certain of your activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice).
One violation related to Waterford-3's policy which allows contractor
supervisors 90 days to complete the required supervisory training.
10 CFR 26.22 requires that all supervisory personnel, including contractors, be
trained in supervisory aspects of the program prior to assignment of duties.
In accordance with Section V.G.I. of the NRC's Enforcement Policy, no citation
is being issued for the second violation described in Section 6 of the enclosed
inspection report.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence.
After reviewing your response to this
Notice, including your proposed corrective actions and the results of future
inspections, NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements,
