AP-600 Plant Description Document Dear Mr. 01 Piazza
-In your letter of February-1,1991 (AW-91-124), you requested that the entire revised AP-600 Plant Description Document be treated as proprietary information within the provisions of 10 CFR 9.5(4). Aside from the fact that your citation to the regulations is incorrect, we will not treat the entire AP-600 Plant Description Document as proprietary because part of the document does not constitute trade secrets or privileged or confidential commercial or financial information and because no documentation was provided in support of the request for withholding as rtquired by 10 CFR 2.790(b).
In addition, the subject document will not be treated as propriettry simply because you allege that it is not currentl 10 CFR 2.790(a)y.a part of a license application or other action identified in We consider this to be an overly restrictive interpretation of10CFR2.790(a). Any information that is submitted to the NRC fcr our review will be trade available to the_ public in accordance with the. requirements of 10 CFR 2.790.
In an accompanying letter from Mr. Johnson (NS-NRC-91-3565), it was stated that a Westinghouse Electric Corporation copyright notice was attached.
Notwith-standing the fact that the copyright notice was not attached, we are familiar with the generic Westinghouse copyright notice and it would not chonge our position on' proprietary treatment of the subject document.
Therefore, you are hereby notified that your request for proprietary treatment of the entire AP-600 Plant Description Document is denied.
In accordance with the provisions of 2.790(c), you n.ay withdraw your submittal of 40 copies of the-subject document or you may submit a-request for proprietary treatment of portions of the subject document pursuant to 10 CFR 2.790(b).
If you do not request with-drawal or withholding of the subject document within 30 days of the date of this letter, then the entire AP 600 Plant Description Document will be placed
