SUBJECT:
POSSIBLE VIOLATION OF 10 CFR 50.7 On December 20, 1990, the U.S. Department of Labor's Wage and Hour Division in Fort-Worth, Texas, received a complaint from an employee of flumanco, Inc., a contractor to TV Electric at TU Electric's Comanche Peak Steam Electric Station (CPSES). The employee alleged that he had been the subject of a discriminatory employment action, i.e., a demotion f rom his supervisory position, for having voiced concerns about not having enough fire watch-personnel at CPSES.
In_ response to that complaint, the Wage and Hour Division secured an employer-employee conciliation which resulted in the individual's reinstatement to a. supervisory position, effective January 1,1991. This conciliation was-confirmed in a March 8, 1991, letter from G. K.-Holtz of-Westinghouse-Electric Corporation, which owns Humanco, to Roy Watkins of the Department of Labor.
LWhile we recognize that llumanco, Inc., appears to have settled its differences with-this' individual, NRC must review this matter to determine whether a
- violation of 10 CFR 50.7. may have occurred. Such a violaticr if it occurred, a
could have a chilling effect on'other contractor or licensee personnel in-that it might deter them from identifying any nuclear safety related concerns tney' may have..
Therefore, you are requested to provide this office, withia 30 days of the-

Describes the actions, if any, taken or planned to assure that this erreloyment action does not have a chilling effect in discouraging other contractor or licensee employees frem raising perceived safety concerns.
After reviewing your response, the NRC will determine whether enforcement action is necessary at this time to ensure compliance with regulatory requirernents.
Please indicate in your response whether any of the information that you provide should be withheld from public disclosure baseo on the provisions of 10CFR2.790(a).
Please cite the specific provision of this regulation that is applicable or other basis for nondisclosure.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reauction Act of 1980 Pub. L. No.96-511.
