Dear Mr. Hill:

I am responding to your. letter dated January 24, 1991, and the December 7, 1990 letter signed by Ms. Greta Dicus on-behalf of the Agreement States.

The Commission appreciates your candid comments and values the perspective that the Organization of i

-Agreement States provides on issues associated with implementa-tion-of-the Agreement-State program.

In that regard, I want to congratulate you, on: behalf of the Commission, on your election as Chairman of the Organization of Agreement States.

Both your letter and Ms. Dicus' letter expressed-concerns about the relationship between the Agreement States and the Nuclear Regulatory Commission (NRC).

Because of the significance or the

-concerns raised, I have asked Carlton Kammerer to convene a meeting.'between NRC.' staff and representatives _of the-Agreement States to' discuss these issues of mutual concern and to develop a plan for resolving them.

I understand that this meeting has been

-scheduled for March 7,-1991, and I look forward to meeting With you personally on March 8 to explore ways to strengthen our regulatory _ partnership.

Additionally, the Commission is currently scheduled to-be briefed-by the NRC staff on March 15, 1991, on the results of an analysis of compatibility issues, including many of--the issues thatLyou raised in your letter.

The analysis provides a foundation for the Commission to consider these important issues.. In view of your interest in-this matter, we would like-to extend an invitation to you to brief the Commission on the views of the Organization of Agreement States after you have completed the-task force report on compatibility issues described in your

. letter and we have had an opportunity _to review the report.

The Commission will be in'a position to provide a more detailed response _to your comments subsequent to review of analyses prepared by the NRC staff and organizations such as your own.

-2 I want to assure you that the Commission is committed to a strong partnership with the Agreement States in ensuring protection of the public health and safety.

In thin spirit of cooperation, I understand you have been informed that we are initiating a consensus-building process to clarify differences and work toward resolution of low-level radioactive waste disposal issues related to implementation of the Commission's "Below Regulatory Concern" (BRC) policy.

The goal of this process will be to identify issues, clarify concerns, and develop recommendations to the Commission, including revisions, as appropriate, to the BRC policy as it relates to exemptions for low-level waste disposal.

The Commission will defer action on petitions for rulemakings that would exempt BRC wastes while carrying out this consensus-building procesc, We look forward to working with you and the Agreement States to resolve your concerns in a mutually acceptable manner.
