In the Matter of Docket No.(s) 5054 OLA CINTICHEM INCORPORATED (Facility Ucense No. R 81) g. g g g 1991 MOTION FOR EXTENSION OF TIME 'It) FTLE RESPONSES TO NEW YORK STATE DEPARTMENT OF ENVIRONi3NTAL CONSERVATION'S REOUEST-FOR HEARING AND PE nTION TO INTERVENE On February 14, 1991 the New York State Department of Environmental Comervation (NYDEC") filed a request for hearicg and petition to latervene in the proceeding concerning the proposed issur.nce by the NRC of Orders authorizing Cintichem, Incorporated ("Ucensee') to dismant!c the reactor facility and dispose of the component parts, and termination of Facility Ucense No. R 81 The Staffs respome to this filing is due on March 6,1991.
Negotiatiom are taking place between the parties whleb will likely settle this matter and obviate the need for response to NYDECs requests. The Staff, therefore, moves that the due date for the filing of respomes to said requests by NYDEC be extended to Mareb 12,1991 to allow the NRC, Ucensee and NYDEC to complete negotiations whleb would result in a withdrawal and NYDECs requests and alleviate the need for a bearing. Counsel for Ucensee joins in this motion and Counsel for NYDEC supports the granting of an extension of time for the Str.fi to respond to its request and i
