MOTION FOR EXTENSION OF TIME TO FILE RESPONSES TO NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION'S REQUEST FOR HEARING AND PirITrlON TO INTERVENE On February 14, 1991 the New York State Department of Environmental Conservation ("NYDEC") filed a request for hearing and petition to intervene in the proceeding concerning the proposed issuance by the NRC of Orders authorizing Cintichem, Incorporated (" Licensee") to dismantle the reactor facility and dispose of the component parts, and termination of Facility License No. R 81 The Staffs response to this filing is due on March 6,1991, Negotiations are taking place between the parties which will likely settle this matter and obviate the need for response to NYDECs requests. The Staff, therefore, moves that the duc date for the filing of responses to said requests by NYDEC be extended to March 12,1991 to allow the NRC, Licensee and NYDEC to complete negotiations which would result in a withdrawal and NYDEC" requests and alleviate the need for a hearing. Counsel for Licensee joins in this motion and Counsel for NYDEC supports the granting of an extension of time for the Staff to respond to its request and petition.
