February 28,1990 MOTION FOR SECOND EXTENSION OF TIME IN WHICH TO FILE CONTENTIONS On February 13,1991, the Minnesota Depanment of Public Service and the Minnesota Environmental Quality Board (Minnesota Agencies) filed a Motion for Extension of Time in Which to File Contentions in the above-captioned proceedmg. The request was to extend the deaoline for filing contentions until Marcn 1,1991. Nonhern States Power Company (NSP. the Company) and counsel for the NRC Staff authonzed the Minnesota Agencies to represent to the Atomic Safety and Licensing Board (ASLB, Board) that no objections would be raised to the requested two week extension.
in the course of the review of the license application of NSP's independent Spent Fuel Storage Facility (ISFSI) by the Minnesota Agencies, several matters have been raised with respect to the proposed facility. Since the original extension was requested, NSP and the Minnesota Agencies have been involved in settlement negotiations. .v Agencies, thus eliminating the need to file contentions. An additional week's time (until Maren 8,1991) is necessary to pursue these discussions.
Consequently, the Minnesota Agencies respectfully request that the deadline for filing contentions be extended for an additional week, until March 8,1991.
Such an extension would necessitate that deadlines for responses to any contentions be extended by a week.
NSP and counselIor the NRC Staff have authorized the Minnesota Agencies to represent to the Board that no objections will be raised to the requested extension. Consistent with the telephone conference with the Chairman of the Board, and as agreed between the parties, the time in which NSP must file its responses to any contentions filed by the Minnesota Agencies will be extended from March 11,1991 until March 21,1991, and the time in which the NRC Staif may submit its comments and responses will be extended until March 25,1991. The preheanng conference remains scheduled for Apnl 2,1991. All pleadings will be served in such a manner that they are received by the Board and the parties on the date such pleading is due.
WHEREFORE, the Minnesota Agencies respectfully request that the deadline for contentions be extended until March 8,1991, and that the heanng schedule be amended as described above.
