The item, Mr. Chairman, is SECY 91-12
- 031, entitled Appeal from a Licen?ing Board order of 13 November 19,_1990'in the Shoreham Proceeding.
14 The Commission is being asked to respond to an 15 appeal by the Shoreham-Wading River Central-School District 16 and the Scientists and Engineers for Secure Energy, Inc.,
17 from a November 19, 1990 Order of the Atomic Safety and i
18 Licensing Board.
The Board order denied - the petitioners 19 request for a Restraining Order and for other relief.
20 All' Commissioners have -' approved an order which 21 dismisses the appeal noting that the Board Order is clearly 22 interlocutory and that the Commission's rules do not permit 23 interlocutory appeals.
In the alternative, treating the 24 petition _as a request for discretionary certification, the 25 Commission also denied the request ac unsupported.
