- DESIGN MODIFICATION FOR LICENSE AMENDMENT REQUEST 90-003 We have evaluated-your approach in developing a pending design modification to your diesel generator (DG) start circuitry.

Your letter dated December 5, 1990, submitted proposed amendment 90-003 to the Comanche Peak Technical Specifintions to be issued in conjunction with the design modification.

Your 1

letter indicated that prior NRC approval of the design modification is not required.

Discussions with your staff indicate that this TU position was e

taken because the design change was reviewed under 20 CFR 50.59 and did not involve an unreviewed safety question.

Section 50.59 of Title 10 of the--Code of Federal Regulations allows licensees to make specified types of changes to.their facilities "without prior Commission approval, unless the proposed change, test or experiment involves a change in the technical specifications incorporated in the license or an unreviewed safety question" [10 CFR 50.59(a)(1)]..Your December 5, 1990, license amendment

application stated that a Technical Specification change will be necessary to be consistent with the pendini design modification.

Since the proposed design change does involve a change in the technical specifications, prior Commission approval.is required under 10 CFR 50.59.

Mr. Don Woodlan of your staff has indicated that'the work package'for the design change has been modified to include a statement to verify that the license amendment has been issued prior to incorporating the design charge.

This should ensure that the Technical Specifications reflect the plant design.
