NDFC 91-1 NUCLEAR DECOMMISSIONING FINANCE COMMITTEE i SEABROOK DECOMMISSIONING FUND RESPONSE TO MOTION TO MODIFY PROCEDURAL ORDER NO. 1 Now comes the Of fice of the Consumer Advocat, and in Responso to New Hampshire Yankee's Motion to Modify procedurel Order No. 1, says:

1. The Of fice of the Consumer Ad.vocato ("OCA") -received, on 20 February 1991, said Motion to Modify, from Edward A. Haffer Esq., dated 14 February 1991, on behalf of New Hampshiro Yankec. Insofar as the OCA roccived this motion 6 days post issuance, we consider this responso to be timely.

2 In said Motion, New Hampshiro Yankee requests a one month extension in timo, (i.e., from 15 April 1991 to 15 May 1991) for filing New Hampshiro Yankoc's decommissioning testimcGy of TLG Engineering, Inc. ("TLG") and William M. Mercor-Moidinger-Hanson Asset planning Incorporated ("Mercor-Meldinger").

3. New Hampshiro Yankee requests that the schedulo of hearings not be altered despite the f act that p' ties such as the OCA will have a month less time to propaa ;huir response.

4. Assuming the NDFC accommodatos th- Now Hampshiro Yankoo request, the OCA requests that all deadlines and datos post the revised 15 May 1991 deadlino for TLG and Morcor-Moidinger testimony and reports be correspondingly adjusted one month back. The present schedulo, prior to New Hampshire Yankoe's request, is already so short the OCA believes it is the minimum in which it can effectively respond.

WHEREFORE, the Office of the Consumer Advocato respectfully

requests the Committoo deny New Hampshiro Yankoo's request to maintain the same hearing schedulo and instead adjust the entire procedural schedule by one month.
