DOUB,;MUNTZ1NG AND GLASG0W DRAFT AGREEMENT BETWEEN NRC & AECL I _have received your comments on the subject agreement transmitted by memoran-dum of January-15, 1991.

At this time, the comments ~on=the' draft agreement are moot because Atomic Energy Canada, Limited, Technologies (AECLT) does not appear to be interested in pursuing direct funding _of a CANDU technology exchange pro-

-gram.

This position was. conveyed at a November 27, 1990, meeting between AECLT and a NRC-negotiating team.

Jerry Wilson, the RES representative on the nego-tiating team was present at this meeting.

-The-staff-is work.ing with'OGC'to prepare an-0GC response to a Commission-staff requirements memorandum asking about_the possibility of obtaining direct funding from Canada for technology transfer.

Before the meeting of November 27, 1990, the' staff (including OGC)" developed two proposals that would allow AECLT

-to reference, in a design certification a) plication, the staff review of CANDU technology paid for by direct funding.

T1e OGC response to the Commission should be consistent with'these proposals and should define the limitations of aidirect funding agreement (e.g., what constitutes " licensing" services that' are covered by 10 CFR Part 170).. This position would be the basis for any future efforts to establish direct funding of a review of the CANDU technology.

We have considered your comments on the draft agreement prepared by Doub, Muntzing and Glasgow. ~We will involve the Office of Nuclear Regulatory Research. staff-in.any future effort to establish an agreement for the direct-funding,of a review of the CANDU technology'0risinaleignoo bt Frank J.
