In support of their motion, Licensees state the following:

1.

In ALAB-862,1 the Appeal Board affirmed the denial of United State Senator Gordon J.

Humphreys's petition to intervene in these proceedings as an " interested state" pursuant to 10 C.F.R. 52.',15 (c).

The Appeal Board went on to note, however, that "by virtue of his office", Senator Humphrey was " called upon to represent the interests of his constituents, the citizens of New Hampshire, on all matters relating to the federal government",2 and accordingly the Appeal Board invited the Senator to participate in the nature of an amicus curiae.

On December 5, 1990, Mr. Humphrey resigned his seat as New Hampshire's representative in the United States Senate, thus terminating the relationship which gave raise to his amicus status.

For several years prior to his resignation, moreover, Mr.

Humphrey had not availed himself of the opportunity to submit amicus briefs.

4.

At the request of Senator Humphrey, the Licensees have been serving copies of all filings to him at both his Washington and his Concord senatorial offices.

Upon information and belief, Mr. Humphrey no longer maintains those offices, and so service of pleadings to those addresses is inappropriate.

Deletion of the two addresses for Mr. Humphrey will shorten the lengthy service lists for these proceeding, thus increasing efficiency in filing and service for the active participants.
