jurisdictional grounds of Basis A of his Contention No. 56;2 In ALAB-942,3 we agreed that rejection was in error and, accordingly, reversed and remanded for further proccodings.
We now have in hand a Joint Stipulation Regarding Contentions Romanded in ALAB-937 and ALAB-942, filed with 1

counsel for the applicants and the NRC staff, the following appears (at p. 4):
In the light of the changes made to the SPMC (i.e., Seabrook Plan for Massachusetts Communities) subsequent to Mass AG's filings of his contentions in April, 1988, as reflected in the provisions of the SPMC as it was admitted into evidence and litigated, Mass AG agrees that the issues raised in Mass AG Contention 56 Basis A, as remanded in ALAB-942, have been resolved.
Mass AG accordingly withdraws his Contention 56 Basis A.
We take that statement to be a concession on the part of the MassAG that, prior to the filing of hic appellate brief a year ago (indeed well before the rendition of LDP-89-32), the substantive issue presented by Basis A of Contention No. 56 had boon resolved on the strength of changes in the SPMC that were reflected in the evidentiary record.
This being so, it would appear that, in assailing in his brief the Licensing Board's jurisdictional ruling respecting Basis A, the MassAG was asking us to consider an entirely academic matter.
In the circumstances, we are constrained to request the MassAG to explain the foundation for this seeming waste of this Board's resources.
His explanation, to be submitted in memorandum form on or before February 1.
1991, should also l
indicate whether there are other and yet undecided issues raised by his pending appeal that are either (1) similarly now concededly resolved; or (2) susceptible of resolution by stipulation on the basis of SPMC changes or otherwise.

upon receipt of the MassAG's meinorandum, responses from the other parties appear warranted, the time for those responses will be fixed in a subsequent order.
