NOTICE OF VIOLATION I

Nalco Chemical Company General License (10 CFR 31.5)

Troy, Michigan 48084 As a result of the inspection conducted on August 15-28, 1990, and in accordance l

with the ' General Statement of Policy and Procedure for NRC Enforcement Actions,*

10 CFR Part 2. Appendix C, (1989) (Enforcement Policy) the following violations l

were identified:

1.

10 CFR 31.5(c)(2) requires that any person who acquires, receives, possesses, uses or transfers byproduct material in a device pursuant to i

the general license in paragrap1 (a) of this section shall assure that the device is tested for leakage of radioactive material at no longer than six-month intervals.

t Contrary to the above, since its purchase in November 1988, a nominal 900 microcurie aromethium-147 sealed source, Serial No. 102355, utilized I

in a Betascope anckscatter gauge had not been tested for leakage of radioactive material.

This is a Severity 1.evel IV violation (Supplement VI).

10 CFR 31.5(c)(8) requires that any person who acquires, receives, f

possesses, uses, or transfers byproduct material in a device pursuant to the general license in paragraph (a) of this section, transfer or dispose of the device only by transfer to a person holding a specific license to i

receive the device.

Contrary to the above, during the period of November 1986 to approximately

[

January 1989, a Betascope backscatter gauge, Model No. 26195, containing a nominal 900 microcuries of promethium-147 in a sealed source, Serial No. D10?355, was transferred in an unauthorized manner.

Specifically, the promethium-14' sealed source was transferred to a Halco Chemical Company service representative in Munster, IN, who did not hold a specific license to receive the device.

This is a Severity 1.ev?1 IV violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice witten statement or explanation in re)1y, including for each violation:

( 0 the corrective steps that have been taien and the results achieved; (2) the corrective steps that will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Consideration may br: given to extending your response time for good cause shown.
