Dear Hr. Klein:
-This refers to our telephone conversation of September 11, 1990, informina' loss and you of the special inspection conducted on August 15-28, 1990, involving the retrieval of a sealed source of promethium-147.
t The inspection revealed that a Betascope backscatter gauge containing a promethium-147 sealed source was transferred to Inland Steel Corporation (Inland) by Halco Chemical Company (Nalco) in approximately January 1989. The promethium-147 sealed source was used there to measure coating thicknesses on steel until approximately February 1990 when Inland requested the service 3
representative of Nalco to exchange the promethium-147 sealed source for a i
cadmium-109 sealed source.
A general license is issued pursuant to 10 CFR 31.5(a) and (b) to commercial and industrial firms to acquire, receive, possess, use or transfer byproduct material contained in devices which have been manufactured or initially transferred and labehd in accordance with 10 CFR 32.51 or with the saecifications contained in a specific license. issued by an Agreement State whic1 authorizes distribution to persons generally licensed by the Agreement State.
The promethium-147 sealed source described above was acquired from Nalco which does not hold a specific license pursuant to 10 CFR 32.51 or an Agreement State license authorizing distribution of this i
material. The acquisition of the promtthium-147 sealed source by Inland from Nalco constitutes an apparent violation of NRC requirements as described in the enclosed Notice.
Response to this violation is not required since Inland returned the promethium-147 sealed source to Nalco in approximately February 1990.

.it is our understanding that in the future, Inland will obtain generally licensed devices only from companies specifically authorized to distribute

NOTICE OF VIOLATION Inland Steel Corporation Non-Licensee East Chicago, Indiant Docket No. 999-90063 As a result of the inspection conducted on August 15-28, 1990 and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2. Appendix C, (1989) (Enforcement Policy) the following violation was identified:
10 CFR 30.3 requires that no person possess or use byproduct material except as authorized by a specific or general license issued pursuant to Title 10 Chapter 1 Code of Federal Regulations.
Contrary to the above, from approximately January 1989 to February 1990, Inland Steel Corporation, East Chicago, Indiana possessed and used approximately 900 i
microcuries of promethium-147 in a sealed source contained in a Betascope backscatter gauge without a valid license.
This is Severity Level IV violation (Supplement VI).
No response is required.
M 5 'nspection showed that steps had been taken to correct the identified
' Ation and to prevent recurrence.
Consequently, no reply to the violation required and we have no further questions regarding this matter.
