SUBJECT:

PETITION FOR CERTIORARI, NUMARC V. PUBLIC CITIZEN AND_NRC

Dear Mr. Lee:

Thank you for your letter of September 11, 1990, regarding your organization's petition to the Supreme Court for a writ of certiorari in Nuclear Management and-Resources Council Inc., v. Public CTITzen ii IT. and UnTTeB 5tates E cTiir,

ReSulifori Tommission el il-- IEE operator traTnTng TTtTgiiT5n-- ETIF NURXRC, tee NRC believes that there were serious deficiencies in the Court of Appeals decision.

This was reflected in the petition for rehearing we filed with.that Court.

We expect that this will also be reflected.in the Government's response to the petition for certiorari.

I understand that, at the request of NUMARC counsel, a meeting

-that will be attended by Department of Justice attorneys, the NRC Solicitor, and NUMARC representatives is scheduled for today,. September 19, to discuss the Government's response to the petition.

It is expected that the response itself, which will be a joint effort of the NRC'and the Department of Justice, will not.be filed until the latter part of October.

We very much appreciate receiving your views on this case.

Sincerely, Y

l'
