RESPONSE OF ALABAMA ELECTRIC COOPERATIVE TO ALABAMA POWER COMPANY'S MOTION FOR STAY OF MANDATE For more than a decade Alabama Power Company has been seeking to stave off the relief which Alabama Electric Cooperative has been held entitled to in this extended litigation. The Company's effort now has nearly run its full course. The Company should not be encouraged, or'even permitted, to put off 'cil the fall of 1983' a decision by .

the Supreme Court on any petition for certiorari which the Company may choose to file. Undue delay at this stage will be seriously prejudicial to Alabama Electric Cooperative.

Accordingly, in acting on the Company's motion for stay of mandate for 30 days pending the filing of a petition for certiorari, it is suggested that the Court add a provision expressly to the effect that if a petition for certiorari

4 has not been filed within the specified 30-day period, then a further stay of the mandate will not be granted by this Court.
