Dear Administrative Judges:

Staff counsel on February 2,1983, received counsel for the Shoreham Opponents Coalition's (SOC) letter dated January 28, 1983.

SOC's letter advises that SOC "* *

  • adopts the proposed findings of fact and conclusions of law filed by the County of Suffolk on the nine safety issues designated by the Board for proposed findings at this stage of the proceeding."

The Staff has no objection to SOC's adoption of the County's findings. The Staff notes, however, that mere adoption of the County's findings by SOC would not, at the appropriate time, support the taking of exceptions by S0C to any initial decision issued by this Licensing Board. See Florida Power and Light Company (St. Lucie Nuclear Power Plant, Unit 2), ALAB-280, 2 NRC 3, 4 at n.2 (1975); Northern States Power Co. (Prairie Island Nuclear Generating Plant, Units 1 & 2), ALAB-244, 8 AEC 857, 864 (1974).
