-ARTICLE I STATEMENT OF HORK A.nackoround The United " States flucicar Regulatory Commission is responsible for the protection of the public health and safety in the civilian use of nucicar power and nuclear materials.

In the performance. of its

duties, the NRC utilizes a wide variety of, automatic data processing, encompassing numerous applications, including scientific, administrative and management information systems.

The Office of Resource Management (RM) is responsibic for ADp uithin the NRC.

RM is sophisticated telecommunications netuork, which links striving

'f cir a

all of its ADP capab i li ti es, and for an environment which strongly supports distributed processing, such as the use of hierarchical languages (i.e.,

ADABAS and 52K) and the introduction

,of office automation.

D.roulnment The NRC does not own a mainframe computer to perform large-scale data processing operations, and depends primarily on buying computer time (timesharing) from DOE National Laboratories, the National Institutes of Ilealth (NIH)

DCRT Federal Data Processing Center, and commer c i al sources.

NRC's ADP equipment to support timesharing consists of remote job entry

stations, data terminals, and associated telecommunications equipment needed for data transfer and communication with the facility at which the computcr is located.

HRC now utilizes over 250 individual terminals and nine remote job entry stations.

The telecommunications equipment needed to accommodate this remote computer usage consists of about 260 modems of various types.

Most of these modems are used with dial-up telephone lines.

Six leased telephone circuits are also used -- two circuits connect NRC to the Central Scientific Computing Facility at Brookhaven National taboratory; one circuit is used to transfer encrypted, classified nuclear materials inventory data between NRC and the Oak Ridge Natianal Laboratory's Computer Science Division K-25 Computer Conter;

!one circuit connects NRC to the Germantoun, Maryland node of DOE's secure message network (SACNET); and two circuits connect the remote

A fourth Data General C350 Eclipse is used by RM for system development, maintenance and backup to the first three dedicated minicomputers.

A fifth mini, a Data General S230 Eclipse, operated by RM, is used to provide small-scale, general purpose timesharing services.

.A sixth mini, a liculett-Packard 1000, is dedicated to the Commission's Public Document Room (PDR) document' indexing, storage and retrieval system.

The remaining four minicor.puters (two Data General C330's and tuo Data General C350's) are dedicated to the development, maintenance, and operation of the Document Control System.

Of the 10 minicomputers, only four provide dial-up, remote access capability the mini available for timeshared use; the mini dedicated'to the Automated Personnel System; the mini used for systems development and maintenance; and the PDR mini.

Beyond the required modems, no special lines or other telecommunication resources are used.

In addition, the NRC now has about 200 pieces of word processing equipment, including stand-alone and shared systems with cathode ray tubes and high-speed laser printers.

Capabilities range from stand-alone memory and magnetic card typewriters to networked, shared-logic systems.

Softuare Softu,re (computer programs) can be categorized as follows:

Category 1 Proprietary' softuure used to aid in applications development as supplied by the hardware or independent vendor.

Such software is used where applicable to significantly cut development and maintenance costs and to help non-ADP personnel use the computer as an information tool.

Category 2

- Proprietary software supplied by the hardware vendor reinted to computer systems operations.

Category 3

- User-developed software using higher-level languages and proprietary package interfaces.

Such software is developed to satisfy specific user requirements in business and scientific applications.

Proprietary software, as defined in Category 1,

is either purchased or leased from specific vendors and is often termed " package software."

It is designed to perform either specific or general functions.

Although the NRC has no specific applications packages at the present time, they might include accounts receivables, budget, and payroll.

Proprietary

software, as defined in Category 2,

includes computer-operating-systems-related support utilities that are not accessibic/changeabic by the applications programmer.

In the IBM environment at

NIH, the operating system is termed OS/VS (Operating System / Virtual Storage).

Support utilities include those supplied by IBM for disk pack maintenance and similar housekeeping tasks.

Other software falling within this category includes language compilers (BASIC,

COBOL, FORTRAN),

file and data management software (ISAM, i

VSAM), and communications hendlers (TSO and parts of WYLBUR).

The NRC currently has two operating systems (A05 and RDOS) used on its Data General Eclipse m i n i compu t ers.-

The H-P 1000 uses HP/ RTE-4B.

User designed and developed software, Category 3,

is the most used within the Commission.

Software of this type eminates from detailed speciftcations designed for a specific purpose within a given system (i.e.,

a daily report of personnel actions).

Programs of this type are usually written in high-level compiler languages such as

COBOL, FORTRAN, or PL/1.
However, proprietary software interfaces can be used with higher-level languages for data base access (i.e.,

SYSTEM 2000 DBMS).

The most commonly used compiler languages within the Commission are COBOL (administrative / management applications) and FORTRAN (scientific approximately 100 applications).

At the present

time, there are administrative / management systems in operation which are made up of
about 2400 computer programs.

Scientific codes currently in use number approximately 250.

C.. Fnc'i l i t i ci NRC supports ADP activities at five regional offices and 10 hoedquarters buildings.

This distr *buted ADP environment requires the piecement of equipment at all.15 locations.

Some locations need only deta terminals and therefore require no special facilities; others house minicomputers and remote job entry stations which require special f a,c i l i t i e s such as power supplies, humidity and temperature controls, raised flooring, access controls, and storage space.

Remote job entry stations are located in each of the five regional offices and at four headquarters sites.

All 10 minicomputers are at headquarters in five different buildings.

SCOPE OF WORK

'# h e contractors shall provide the necessary personnel, materials, and fecilities, except when otherwist noted in. approved task orders, to fulfill the requirements of any designated portion of this Statement of Work.

Computer time and use of NRC equipment and facilities may be mede available on an individual task order basis depending upon the scope of,the effort.

The requirements of this Statement of Work include the steps necessary to develop automated information systems in support of the objectives of the U.S.

Nuclear Regulatory Commission.

This involves the preparation of feasibility, cost-benefit and risk analyses, systems analysis, systems design and preparation of system specifications, preparation of program specifications and program development and testing.

This also involves system documentation, system training, system

testing, and system evaluation.

'All activities performed under this Statement of Work shall be directed by designated officials within the Office of Resource Management (RM) in coordination with the Division of Contracts.

Projects t 'o be performed will be defined in approved task orders which specify the services to be

provided, deliverables, schedules and resource allocations.

In general, it is estimated that the following types of personnel will be required to support these efforts:

Category Minimum Qualifications Project Manager College degree or equivalent plus ap-progressive proximately 10 years or more experience in data processing.

Experience should include performance of feasibility studies, systems

analysis, syctems
design, programming, testing and system installation plus at least two years recent experience in managing projects involving development ac-tivities.

Must have detailed knowledge of project management responsibilities.

Systems Analyst College degree or equivalent plus ap-progressive

Must have detailed knowledge of data base management systems and design techniques for on-line, interactive applications.

Experience must include use of hardware / software utilizing text edit funct, ions for

adding, modifying and/or deleting data groups.

It is also expected that additional categories of personnel will 'be needed on a task order basis in order to satisfy the requirements of specific applications.

These may include, but are not limited to, such categories as reactor engineer, telecommunications specialist, accountant, financial planner or library scientist.

Article II - TYPES OF WORK REQUIRED UNDER TASK ORDERS The, types of automated information system development work Ilkely to-be required under any given task order are defined below.

These are general definitions.

Task orders will reficct, but are not limited to, these definitions.

All tasks and deliverables util be undertaken in accordance with all applicable Federal Information Processing Standards (FIpS).

A.

reasibility, Cost-Denefit and Risk Ana1yses (a) The contractor shall investigate ~the need, feasibility, security and impact of development or modification of the system indicated.

Information review and intervicu techniques uilt be used by tlye contractor.

(b) The contractor shall produce a cost-benefit analysis presenting the

,results of the investigation and alternative courses of act, ion.

The format of the cost-benefit analysis must follow FIPS, guidelines.

B.

Systems Analysis (a) The contractor shall analyze specific and overall requirements of the system to be automated or of the major modifications to be made to an existing system.

The contractor shall review all available system and program documentation for the system specified and conduct interviews with all cognizant individuals identified by RM.

l (b) The contractor shall develop a document summarizing the results of the analysis and specifying functional and data requirements of the system being developed.

This document, which must follou FIPS guidelines, shall include, but not be limited to:

(1) Definition of the reporting universe.

(2) Compliance monitoring and control requirements.

(3) Data collection, reduction and automation requirements.

(4) Data edit, validation, and quality control requirements. ;

(5) Audit trails and document controls.

(6) Data storage, maintenance, and retrieval requirements.

(7) Information reporting and statistical requirements.

(8) Summary of intervieu notes and meet,ings.

(9) Preliminary system concept and overvicu.

(10) liardware recommendations, if appropriate.

(c) As a result of this analysis, the contractor shall provide a

project plan of the system and program development to indicate the anticipated elapsed

time, task
sequence, task interdependency, staffing requirements, hours per labor category, and milestones for each task to performed.

(d) The Office of Resource Management shall review the functional and data requirements document and project plan, for acceptance or revision, during which time the contractor may only proceed with other approved activities of the current task order.

Systems Dacign And Properot ten "of Sycted Specificot ienc

  1. ('o ) 'Besad en the functional end date requirements, as approved, the contractor shall develop detailed system design specifications.

These system design specifications shall define the overall system

concept, including all manual and automated processing, data sources, files, reports and controls.

(b) System design specifications shall also consist of detailed statements, following RM documentation' guidelines, concerning development time for all aspects of t h'e proposed system.

The contractor shall prepare a

time-phased development plan of milestones and scheduled dates for all activities.

The contractor shall anticipate lead-time for finalization and required approval for any proposed data collection forms.

The contractor may not proceed with the development of the system until author i zed to do so, in writing, by RM.

D.

Preparation of Program Specifications Based on the systems specifications developed in 3.3, as approved or revised by the

NRC, the contractor shall develop a

document containing program specifications outlining the

purpose, input, output and development methodology for each computer program in the system.

This program-specifications document must follow FIPS guidelines.

In the case where an existing program is to be modified, program specifications shall be required outlining the extent of the modifications.

In both cases, to the maximum extent

feasible, the contractor shall make use of FIPS programming standards and conventions.

No programming shall be performed until authorized by RM.

E.

Program Development and Testing Following review and approval of individual program specifications, the contractor shall proceed with program development and testing.

Programming and testing must be conducted in a

manner so that progress on individual programs and subsystems is not delayed by interdependencies, i.e.,

each program and system must have its own set of test data.

Program development and testing includes:

(a) Coding of computer programs.

(b) Testing of individual programs.

(c) Revision and refinement of specifications.

(d) Development and utilization of system batch and interactive execution procedures.

System Documentation The contractor shall develop written procedures for the

use, operation and maintenance of each system.

This documentation shall include such elements as source-document procedures, establishment and maintenance of data bases, and any other peripheral functions and procedures necessary for the operation, use and maintenance of the syst.cm by RM.

This documentation shall be in the form of user, operations and system maintenance manuals prepared following FIPS documentation guidelines.

approval, the contractor shall provide the training to appropriate NRC personnel.

System Testing (a) The contractor shall develop a

test

plan, following FIPS Suidelines, outlining the approach to be followed in demonstrating the functional capabilities of the system.

The demonstration shall provide evidence of all specified edits and error messages, successful execution of predictable

results, i

successful recycling and correction of errors, and demonstration of audit trails.

The test plan shall also specify an appropriate methodology for desk

checking, unit testing and systems integration.

(b) After RM approval of the test plan, the contractor shall execute the test according to the plan and prepare a test analysis report.

The test analysis report must follou FIPS documentation guidelines.

(c) Using the test analysis report, addenda to the test plan will be

prepared, approved and executed to fully resolve all system problems.

As the test plan addenda are

executed, appropriate addenda to the test analysis report will be prepared by the contractor.

System Evaluation The contractor shall review documentation, observe operation and interview appropriate personnel in order to perform an evaluation of the effectiveness, efficiency and need of a system.

The resulting system evaluation report must follow FIPS documentation guidelines.

SYSTEMS ENVIRONMENT Types of systems to be developed will include, but will not be limited io, (1) work assignment management, (2) information transfer, (3)

11RR Dperator Licensing Article III - Task Order Reporting Requirements The Contractor shall deliver to the NRC project officer all manuscripts, or other written materials required under any resultant task orders, based on the following criteria:

(a) Such material shall be in accordance with all applicable FIPS documentation standards and NRC Manual Chapter 3202.

(b) Such material shall conform to normally accepted criteria for grammar, organization, unity, coherence and clarity.

Upon receipt by the Contractor of written approval of the materials submitted, the Contractor shall prepare and submit one (1) manuscript copy and five duplicated copies, the distribution of which shall be specified in the individual task order.

In the event of nonconformity with the criteria outlined above, the NRC may return the materials for correction, rewrite or other such action as may be deemed appropriate.

Article IV - Task Order Procedure NRC will, from time to time, issue individual proposed task orders which will be numbered consecutively with a three-digit number commencing with "001" with appropriate prefixes and suffixes for NRC control purposes.

Each proposed task order shall be sent to each Contractor and will include:

For purposes of award, each task order shall specify a selection plan as set forth below to be used as the basis for the decision:

1.

Reasonableness of price / cost; and/or 2.

On the basis of technical evaluation of initial proposals with oral or written discussions with those in the competitive range; or 3.

On the basis of technical evaluation and discussions with the selected offeror only (i.e., award on the basis of initial proposals).

The selection plan may vary from one proposed task, order to another.

The task order technical proposal shall substantiate the contractor's understanding of the requirements of the task order.

Statements which paraphrase the statement of work of the task order without l communicating the specific state-of-the-art approaches requested by the

NRC, or statements to the effect that the contractor's understanding can or will comply with the statement of work may be construed as an indication o/ the contractor's lack of understanding of the statement of work and deliverables.

The contractor shall, when applicable, state its objectives, methods and any other information explaining how the task will be accomplished.

Any exceptions or deviations to the period of performance or reporting requirements shall also be noted.

Individuals considered to be essential to the successful performance of each task order awarded hereunder shall be identified as key personnel in each task order proposal and shall not be replaced without prior approval of the Contracting Officer.

In such event, the Contractor agrees to substitute persons possessing substantially equal abilities and qualifications satisfactory to the Contracting Officer.

Resumes shall be submitted for all personnel identified who are not already on file with the NRC.

Personnel

shall be considered to be on file for all resumes submitted with the original proposal and all resumes submitted with subsequent task order 1

proposals. On occassion, task orders may contain requests for labor categories which are deemed necessary for the effective completion of the task, but which were not otherwise identified in this document.

For example,

Following negotiation of the contractor's task order proposals, the Contracting Officer will issue a formal, definitized task order.

This will include a full set of administrative procedures to be followed during the performance of the task.

The contractor shall not, under any circumstances, commence work on any task order prior to receipt of the definitized task order signed by the Contracting Officer.

Each task order issued will reflect a

dollar ceiling which the contractor may not exceed, except at its own risk.

The dollar ceiling of a task order may be increased by the Contracting Officer with the exception that the total dollar amount of all completed and out s tanding task orders may not exceed the total dollar ceiling set lforth in this contract.

Task orders may be issued at the sole option lof the NRC, and it is understood that the NRC undertakes no obligation lto issue taqk orders hereunder.

Cost Plus Fixed Fee Task Orders:

1.

Pending the establishment of final overhead rates which shall be negotiated based on audit of actual costs, the Contractor shall be reimbursed for allowable indirect costs hereunder at the provisional ceiling rate of 40% of direct labor and benefit costs.

This rate is subject to downward adjustment only.

2.

Pending the establishment of final benefit rates which shall be based on audit of actual costs, the Contract shall be reimbursed at a rate of 27% of direct labor.

3.

Notwithstanding B.) and B.2 of this article, said provisional overhead and benefit rates may be adjusted as appropriate during the term of the contract upon acceptance of such revised rates by the Contracting Officer.

Article IX - Other Direct Costs Other direct costs proposed on any resultant Task Order and approved by the Contracting Officer shall be reimbursed to the Contractor at actual cost.

Article X - Waiver of Facilties Capital Cost of Money (Oct 1980)

The Contractor is aware that facilities capital cost of money is en allowable cost but waives the right to claim it under this contract.

Article XI-Travel Reimburseme..t Travel reimbursement costs for travel outside the Washington, DC Metropolitan area incurred by the Contractor shall be reimbursed in accordance with rates established in Cahpter 1 of the Federal Travel Regulations (see FPMR 41 CFR 101-7) in effect on the day the actual travel occurred.

To the extend provided tharein, the Contractor will be reimbursed for the following reasonable domestic travel costs incurred directly and specifically in the performance of this contract and accepted by the Contracting Officer:

Per diem for other than high rate areas shall be reimbursed at a daily rate allowed by the Federal Travel Regulations.

The current rate is $23.00 per day, plus lodging not to exceed $50.00. The $23.00 covers meals and miscellaneous expenses.

Receipts are not required for per diem.

When travel is to one of the high-rate geographical areas, actual subsistence costs shall'be reimbursed at a daily rate not to exceed the rates indicated in the Federal Travel Regulations.

Receipts are required for lodging, meals and miscellaneous expenses v.iich exceed $15.00.

The cost of travel by privately owned automobiles shall be reimbursed at mileage rates specified in the Federal Travel Regulations.

The current rate is 20c per mile.

4.

The cost of travel by rented automobile shall be reimbursed on.a reasonable actual expense basis.

The provisions of Paragraph 1-3.2c shall not apply to the contractor.

The expense of additional insurance as referred to therein shall be reimbursable in a reasonable anount.

5.

All conmon carrier travel reimbursable hereunder shall be vai economy class rates when available.

If not available, reimbursement vouchers will be annotated that economy class accommodations were not available.

First-class air travel is not authorized.

6.

Receipts are required for common carrier transportation and lodging.

Receipts are also required for miscellaneous. items in excess of $15.00.

The Contractor shall submit a monthly invoice reflecting all Task Orders issued under this contract and requiring payment for each thirty day period.

Invoice Requirements Invoices submitted under this contract shall be prepared in the following manner.

Each invoice shall be consistent with periodic contract status-reports submitted by the Contractor in accordance with the administrative procedures cited herein and as futher stipulated in each Task Order.

Note: Unless otherwise approved by the Contracting Office, billing for Firm Fixed Price Task Orders shall not be initiated by the Contractor until final delivery is made and NRC acceptance obtained for the services performed.

B.

Payments 1.

Unless otherwise set forth in the Schedule, five percent of the amount due under this clause, excluding amounts claimed under fixed price Task Orders, shall be withheld from each payment hy the Contracting Officer but the total amount withheld shall not exceed $5,000.

Such amounts withheld shall be retained until the execution and delivery of ~ a release by the Contractor.

2.

Unless provisions of the Schedule hereof otherwise specify, the hourly rate or rates set forth in the Schedule shall not be varied by virtue of the Contractor having performed work on an overtime basis.

If no overtime work is approved in advance hy the Contracting Officer, overtime rates will be negotiated.

Failure to agree upon these overtime rates will be treated as a dispute under the " Disputes (

clause of this contract.

If the Schedule providet rates for overtime, the premium portion of those rates will be reimbursable only to the extent the overtime is approved by the Contracting Officer.

Payment shall be made on each type of Task Order as follows:

The Contractor shall be paid an. amount computed by multiplying the appropriate nourly rate, or rates, set forth in the Schedule of the contract, by the number of direct labor hours performed, which rates shall include wages, overhead, genera and administrative expense and profit.

Fractional parts of an hour shall be payable on a prorated basis.

Vouchers shall be submitted once each month.

The Contractor must maintain records which may be used to substantiate vouchers by evidence of actual payment and by individual daily job timecards, or such other substantiation

Additional provisions relating to payment for Cost Plus Fixed Fee Task Orders are contained in the General Provisions attached hereto dated 12/1/81 under Section No. 5 (Attachment 6).

Cost ceilings will be plhced in each Cost Plus Fixed-Fee and Labqr llour Type Task Order issued under the contract.

Such ceilings may be increased by the Contracting Officer at his discretion from time to time by notice to the Contractor in writing.

The Contractor shall promptly notify the Project Officer in writing whenever he believes that the t' hen pertinent ceiling for any Task Order is insuf ficient.

When and,if the amount (s) paid and payabic to the Contractor under such pertinent Task Order shall equal the then pertinent ceiling, the Contractor shall not be expected to perform further unless the Contracting Officer increases such ceiling in an amount sufficient to cover additional work thereunder.

The Government shall not be obliged to pay the Contractor any amount in excess of such ceiling.

Firm fixed Price Task Orders; A fixed amount will be reflected on each firm fixed. price task order.

The Contractor shall satisfactorily perform the services required at the agreed fixed price.

ARTICLE XIV - TECHNICAL DIRECTION A.

Performance of the work under this contract.shall be subject to the tech-XV nical direction of the NRC Project Officer, or his Des.ign.ee camed in Article of this contract. 'The term " Technical Directiori" is-defined to include the follWirig:.

A copy of said written direction shall be submitted to the Contracting Officer.

The contractor shall proceed promptly with the performance of technical directions duly issued by the Project Officer in the manner prescribed by this article and within such person's authority under the provisions of this article.

If, in' the opinion of th contractor, any instruction or direction' issued by the Project Officer,is within one of_ the categories as defined in B(1) through (4) abov6, the contractor shall not proceed but shall notify the Contracting Officer in writing within five (5) working days after the receipt of any such instruction or direction and shall request the Contracting Officer to modify the contract accordingly.

Upon receiving such notification from the contractor, the Contracting Officer shall issue an appropriate contract modification or advise the contractor in writing that, in the Contracting Officer's opinion, the technical direction is within the scope of this article and does not constitute a change under the Changes Clause.

Any unauthorized commitment or direction issued by the Project Officer which is acted upon-by. the contractor may result in an unnecessary delay in the contractor's

The NRC may waive the restrictions of Paragraph 8 in accordanca with its General Statement of Policy on the avoidance of Contractor organizational conflict of interest which appeared in Vol. 42 of the Federal Register, page 21673, dated April 28, 1977.

Article XX

- Subcontracts for Work or Services No contract shall be made by the Contractor with any other party for f urnishing any of-the work or service herein contracted for without approval of the Contracting Officer, but this provision will not be taken as requiring the approval of contracts of employment between the Contractor and personnel assigned for services hereunder.

Article XXI - Security / Classification (Subject to Security Clearance)

The Contractor and contractor's personnel will be governed by (i) the provisions of the Security / Classification Requirements, NRC fom 187, incorporated herein by this reference and attached hereto as Attachment.

To comply with the Privacy Act of 1974 and the rules and regulations issued pursuant to the Act in the design, development, or operation of any rystem of records on individuals in order to accomplish an agency function when the contract specifically identifies (i) the system or systems of records and (ii) the work to be performed by the contractor in terms of any one or combination *of the following: (A) design, (B) development, or (c) operation; To include the solicitation notification contained in this (2) contract in every solicitation and resulting subcontract and in every subcontract awarded without a solicitation when the the statement of work in the proposed subcontract requires the design, development, or operation of a system of records on individuals to accomplish an agency function; and To include this clause, including this paragraph (3), in. all (3) subcontracts awarded pursuant to this contract which requires the design, development, or operation of such a system of records.

In the event of violations of the Act, a civil action may be brought against the agency involved where the violation concerns the design, development, or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers of employees of the agency where the violation concerns the operation of a system of records on individuals to-accomplish an agency function.

For purposes of the Act when the contract is for the operation of a system of records on individuals to accomplish an agency' function, the contractor is considered to be an employee of the agency.

3. i2 Labor Surplus Area Subcontracting Program (1-1.805-3(b))

(a) The Contractor agrees to establish and conduct a program which will encourage labor surplus area concerns to compete for subcontracts within their capabilities.

In this connection, the Contractor, shall--

(l') Designate a liaison officer who will (i) maintain liaison with duly author,ized representatives of the Government on labor surplus area matters, (ii) supervise compliance with the Utilization of Concerns in Lacor Surplus Areas clause, and (iii) administer the Contractor's " Labor Surplus Area Sub-contracting Program;"

(2) Provide adequate and timely consideration of the potentialities of labor surplus area concerns in all "make-or-buy" decisions; (3) Assure that labor surplus area concerns will have an equitable opportunity to compete for subcontracts, particularly by arranging solicitations, time for the preparation of bids, quantities, specifications, and delivery schedules so as to facilitate the participation of labor surplus area concerns; (4) liaintain records showing the procedures which have been adopted to comply with the policies set forth in this clause and report subcontract awards (see 41 CFR l-16.804-5 regarding use of Optional Fonn 61).

Records maintained pursuant to this clause will be kept available for review by the Government until thc expiration of 1 year after the award of this contract, or for such longer period as may be required by any other clause of this contract or by applicable law or regulations; and (5)

Include the Utilization of Concerns in Labor Surplus Areas clause in subcontracts which offer substantial labor surplus area subcontracting opportunities.

(b)

(1) The term " labor surplus area" means a geographical area identified by the Department of Labor as an area of concentrated unemployment or under-employment or an area of labor surplus.

(2) The term " concern located in a labor surplus area" means a labor surplus area concern.

(3) The term " labor surplus a. ea concern" means a concern that, together with its first t.ier subcontractors, will perform substantially in labor surplus areas.

(4)

The term " perform substantially in labor surplus areas" means that the costs incurred on account of manufacturing, procuction, or apprc::riate services in labor surplus areas exceed 50 percent of the contract price.

(c) The Contractor further agrees to insert, in any subccntract hereunder which may exceed 5500,000 and which contains the Utilization.of Concerns in-Labor Surplus ' Areas clause, provisibns.which shall confora s'ubstantially -to the language of this-clause, including-this paragraph-(c),'and to notify the-Contracting.
