of a Director's decision regarding emergency planning 6

deficiencies, in this the Commission is being asked to 7

approve a proposal t..at notes that a review of a 8

Director's decision denying th e pe tition f o r th e 9

shutdown of Indian Point 2 and 3 due to emergency 10 preparedness deficiencies is unnecessary because the 11 Commission's later order, which addressed enforcement 12 issues that issued on December 23rd, 1982, constitutas 13 the Commission's latest view.

14 The Chairman, Commissioners Ahearne, Roberts 15 and Asselstine have approved the proposed order.

16 Commissioner Asselstine has provided additional view.

17 Commissioner Gilinsky is not participating.
