Contract No. NRC-02-83-030 Page 3 of 15 PART 111 CONTRACT SCHEDULE ARTICLE I - STATEMENT OF WORK BACKGROUND:

The proposed regulation on near-surface disposal of low-level radioactive wastes (10 CFR Part 61) requires that, with one exception, such disposal will be in the unsaturated zone above fluctuations of the water table.

Understanding of the movement of

. moisture in the unsaturated zone and the transport of solutes in wetting fronts to the saturated zone are essential in the evaluation of the suitability of a waste disposal site and design features, such as trench caps, at that site.

The Low-Level Waste Licensing Branch (WMLL) therefore has a need to develop an in-house modeling capability for unsaturated flow and t ransport.

In addition, WMLL has decided that this in-house modeling capability shoulf include pre-qualification of a group of computer codes which the s, ff believes adequately represent the movement of moisture and soi 'e in the unsaturated zone and which applicants may select from.

.ais project consists of developing adequate documentation and providing in-house training for some of the computer codes in the pre-qualified group.

The NRC is presently funding two studies directly related to this project.

evaluating available computer codes for unsaturated flow andBattelle transport modeling in order to identify those codes recommended for use by the NRC in site evaluations.

Survey (FIN N0. B6965) is evaluating available computer codes forThe Illinois State unsaturated flow to identify those codes most useful by the NRC in evaluation of the ability of trench caps to limit infiltration.

The computer codes selected by WMLL for this project include:

for each of the computer codes, the contractor shall furnish the necessary personnel, facilities, and materials to perform the following tasks:

Task 1: The contractor shall convert, where practicable without making major revisions to the programs, each of the selected programs to American National Standards (ANS) FORTRAN (per ANSI Standard X3.9-1978, also known as FORTRAN-77).

Programs which do not or are not made to conform to FORTRAN-77 must be fully comoatible with CDC Fortran Extended, Version 4.

The contractor shall then prepare written documentation and an NRC Scientific Software Submittal Package for each code.

The documentation, submittal package, and all programming work performed under this contract shall conform to the requirements described in Appendix D, Scientific Software Development and Submittal Requirements for NRC Contractors.

The applicable code documentation standard for this contract shall be ANSI Standard N-413.

The contractor shall install the software on the Brookhaven National Laboratory (BNL) CDC 6600/7600 system and run the simulation examples for each code to ensure that the software is completely operational.

A BNL account number and computer time for the sof tware installation work will be provided to the contractor by the NRC.

Staff from the NRC Office of Resource Management, Divison of Data Automation and Management Information (RM/D) will provide the contractor with systems-related advice and assistance as required for the code installation.

Resolution of program-related problems or questions, however, will be the responsibility of the contractor.

It shall also be the contractor's responsibility to ensure that the codes sill run properly in the BNL computer facility environment (e.g., core storage requirements must not exceed BNL limits, special library routines not available at BNL must be provided, etc.).

During the code installation period, the contractor will be provided with the use of a CRT terminal at NRC headquarters at Bethesda, Maryland in order to access the BNL system.

Printed and graphical output production facilitics will also be available.

In using the BNL facility for the sof tware installations, the contractor shall follow all RM/D procedures, such as data set naming con 0entions, rules for priority runs, etc.

Rii/D will inform the contractor of these procedures at the time their account number is assigned.

If a computer tape is used, Contractor shall transmit the computer tape to BNL, according to instructions provided by the flRC Project Officer, at least one. week prior to start of installation.

All program development, conversion, and testing prior to the installa-tion of the software at BNL shall be performed using contractor-provided facilities.

The courses should be designed for 12 attendees.

Each crurse shall be designed by the contractor and approved by the NRC Project Officer.

Each course shall cover, as a minimum, the following topics:

1.

Theoretical development of program 2.

Practical considerations for application 3.

Limitations 4.

Data requirements 5.

Interpretation of output 6.

Deck set up 7.

Simulation examples, such that each participant will set-up and run simulations illustrating the various options of the computer codes.

The contractor shall use his/her own discretion in selecting simulation examples and designing the courses; however, the NRC prefers that the courses be somewhat evenly spaced throughout the period of performance.

Each course shall be held in NRC offices.

Access to the BNL computers and computer time necessary for funning course simulations will be pro-vided by the NRC.

At the conclusion of each course, the contractor shall submit a final report containing all course materials, including course notes, visual aids and example problem input and output annotated to illustrate interpretation. This final report shall incorporate, as appropriate, comments received from the NRC Project Officer.

3.0 REPORTING REQUIREMENTS:

3.1 Monthly Letter Status Report:

Each month, contractor shall submit four (4) copies of a brief letter report which summarizes:

(1) the work performed for each of the computer codes during the previous month; (2) personnel time expenditures for each of the computer codes during the previous month; and (3) costs and uncosted obligations, listed separately (a) during the previous month, (b) cumulative to date (fiscal year and total), and (c) projection by month for the current fiscal year. The first monthly report shall either provide revised projections or indicate "no change in the cost and uncosted

j items as activities in progress or completed, key milestones achieved, anticipated problem areas and their effects on other activities and the project schedule, meetings held or attendi d, and peer review group recommendations.

The reports shall be due by the 15th of each month, with distribution as follows:

For Task 1, the contractor shall supply i4RC with a draft final report, for each computer code, consisting of a complete set of the t

written documentation and user's manual as specified in Task 1.

TLe NRC will provide review comments within 30 days of receipt of each draft final report.

Cor. tractor shall submit each final report within 30 days of receipt of NRC comments for that computer code.

Under task 2, the contractor shall submit, at least two weeks prior to each course, a draft report including the course outline, course notes and problems to be used during the training course.

This draf t report should be in the form of a training manual.

The NRC Project Officer shall provide any comments on the training i

mr.nual, as they may affect the teaching of the course, within one week. The llRC Project Officer shall submit comments on the training manual and course from the participants to the contractor within one week after the last day of instruction for each course.

For each computer code, the Contractor shall submit a final report on the training material, including all course materials, course outline, lecture notes, visual aids used, and example problems with results within 30 days of receipt of comments.

The contractor shall submit all final reports in two (2) copies (including or.e (1) camera-ready copy) to the Project Officer, one (1) to the Division of Contracts, one (1) to the Division of Waste Management, and one (1) to the Office of the Director,

All final reports shall conform to NRC Manual Chapter 3202.

A project start-up meeting, antici.ated to last one day, shall i

be held within one (1) week of initiation of the project.

2.

A meeting, anticipated to last one day, shall be held one (1) week before each course is presented to finalize plans and review the proposed course materials.

3.

A meeting, anticipated to last one day, will be held approximately 3 weeks after the submittal of each draft final report for Task 1 in order to discuss NRC comments.

4.

Travel needed to make the computer codes operational on the NRC computer facilities. Contractor shall be allotted up to one week for installation of each computer code.

5.

A meeting, anticipated te last 3 days, to conduct each training course for NRC staff.

All meetings shall be documented by the contractor and the documentation transmitted to the NRC Project Officer in the monthly letter status reports.

All meetings shall be held in NRC offices.

No international travel is expected to be performed under this contract.

Domestic travel to support the work activities shall be documented in the monthly letter status reports.

5.0 NRC-FURNISHED MATERIAL:

The'NRC Project Officer shall provide, within one week from the effective date of the contract, copies of the Task 1 report from B2220 and Task 2 report from B6965 to document modeling studies performed under those contracts.

necessary arrangements, including providing a CRT terminal in NRC offices, for the contractor to have access to the BNL computer system so that the codes can be installed and tested.

6.0 OUALITY ASSURANCE PROCEDURES:

For all programming and final technical reports delivered under this contract, the contractor shall assure that an independent review and verification of all numerical computations and mathematical equations and derivations are performed by qualified personnel other than the original author (s) of the materials.

The output of the computer program shall have been validated by the contractor prior to delivery to the NRC.

Validation shall be by comparison of the output of the program to an accepted analytical solution as proposed by the contractor and agreed to by the NRC Project Officer.

Verification should include comparison to field results where possible.

If the contractor proposes to verify / check less than 100 percent of all computations and mathematical -

equations and derivations in the report (s) (such as might be the case when there are a large number of routine, repetitive.

calculations), the contractor must first obtain written approval from the NRC Project Officer.

Computer-generated calculations wil.1 not require verification where the computer program has already been verified.

7.0 DISPOSAL OF PROPERTY:

Upon completion of.a program or termination ~of a project, a reconciled report will be developed jointly by the contractor and NRC to record availabla. equipment and related material purchased with NRC funds.

This report should be developed as soon as possible after program completion or a termination decision has been made, but not later than sixty days af ter work termination date. The report should be submitted to the Division of Contracts.

Contract No. NRC-02-83-030 Page 9 of 15 ARTICLE 11 - PERIOD OF PERFORMANCE The performance of work described in ARTICLE I hereof shall commence as of the effective date of this contract and shall continue to completion thereof, esti-mated to occur within six '(6) months af ter said contract is effective.

ARTICLE III - OPTION A.

During the course of the anticipated contract, the NRC may elect to exercise an option to have the contractor review a computer coce or codes cther than the two identified in Article I, Section 1.0.

In the event that the option is exercised, the contractor shall furnish the necessary personnel, facilities, and materials to perform Task 1 and Task 2 as delineated in Article I, Section 2.0 above for the required computer code (s).

In no event shall the number of additional codes reviewed exceed two in nunber.

If the NRC does choose to exercise this option, the Contracting B.

Officer shall notify the Contractor in writing or by telegraphic notice to this effect no later than thirty (30) cays prior to the expiration of the contract. The NRC reserves the right to exercise this option either in full or in part. The NRC also reserves the right to perform the additional work in-house. The contractor is further advised that additional code (s) may not be identified for pre-qualification and that the option may therefore not be exercised.

If the option is exercised, all terms and conditions of the contract shall apply to the additionally performed work.

Estimated Cost Fixed Fee and Oblication 1.

It is estimated that the total co>t to the Government for full perform-ance of this contract will be $65,245.53, of which the sum of $60,445.53 represents the estimated reimbursable costs,- and of which $4,800.00 re-presents the fixed fee.

There shall be no adjustment in the amount of the contractor's fixed 2.

fee by reason of differences between any estimate of cost for performance of the work under this contract and the actual cost performance of that work.

The amount presently obligated by the Government with respect to this 3.

The contractor agrees to conform to all regulations, requirements, and directions of the Commission with respect to such material.

The contractor's duties under this c1ause shall not be construed.to Ilmit or affect in any way the contractor's obligation to conform to all s'ecurity regulations and requirements of the Commission pertaining to classified information and material.

ARTICLE VII

- KEY PERSONNEL Pursuant to this ARTICLE (Key Personnel), the following individuals are considered to be essential to the successful performance of the work hereunder and shall not be replaced without the prior approval of the Contracting Officer.

In such event, the contractor agrees to substitute persons possessing substantially equal abilities and qualifications satisfactory to the Contracting Officer.

- TECHNICAL DIRECTION A.

Performance of the work under this contract shall be subject to the tech-nical direction of the HRC Project Officer named in ARllCLE IX of this contract.

The term " Technical Direction" is defined to include the following:

1.

Technical direction to the contractor which shifts work emphasis between areas of work or tasks, requires pursuit of certain lines of inquiry, fills in details or otherwise serves to accomplish the con-tractual scope of work.

2.

Providing assistance to the contractor in the preparation of drawings, specifications or technical portions of the work description.

3.

Review and where required by the contract, approval of technical reports, drawings, specifications and technical inicrma tion to be delivered by the contrac tor to the ~ Government under tne contrac t.

B.

Technical direction must be within the general scope of work stated in the contract.

The Project Of ficer does not hu /e the authority to and may not issue any technical direction which:

1.

Constitutes an assignment of additional work outside the general scope of the contract.

Constitutes a change as defined in the clause of the General Provisions, entitled " Changes."

In any way causes an increase or decrease in the total estireted contract cost, the fixed fee, if any, or the time required for contract performance.

Changes any of the expressed terms, conditions or specifications of the contract.

C.

ALL TECHNICAL DIRECTIONS SHALL BE ISSUED IN WRITING BY THE PROJECT OfflCER OR SHALL BE CONFIRMED BY SUCH PERSON IN WRITING WITHIN TEN (10) WORKING DAYS AFTER VERBAL ISSUANCE.

A copy of said written direction shall be submitted to the Contracting Officer.

The contractor shall proceed promptly with the performance of technical directions duly issued by the Project Officer in the manner prescribed by this article and within such person's authority under the provisions of this article.

If, in the opinion of the contractor, any instruction or direction issued by the Project Officer is within one of the categories as defined in B(1) through (4) above, the contractor shall not proceed but shall notify the Contracting Officer in writing within five (5) working days af ter the receipt of any such instruction or direction and shall request the Contracting Officer to modify the contract accordingly.

Upon receiving such notification from the contractor, the Contracting Officer shall issue an appropriate contract modification or-advise the contractor in writing that, in the Contracting Officer's opinion, the technical direction is within the scope of this article and does not constitute a change under the Changes Clause.

Any unauthorized commitment or direction issued by the Project Officer may result in an unnecessary delay in the contractor's performance, and nuy i

even result in the contractor expending funds for unallowable costs under the contract.

E.

A failure of the parties to agree upon the nature of the instruction or direction or upon the contract action to be taken with respect thereto shall be subject to the provisions of the contract clause entitled " Disputes."

David Siefken, WMLL is hereby designated as the Contracting Officer's authorized representative (hereinafter called Project Officer) for technical aspects of this contract. The Project Officer is not authorized to approve or request any action which results in or could result in an increase in contract cost; or terminate, settle any claim or dispute arising under the contract; or issue any unilateral directive whatever.

The Project Officer is responsible for:

(1) monitoring the contractor's technical progress, including surveillance and assessment of performance, and recommending to the Contracting Officer changes in requirenants; (2) interpreting the scope of work; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting the contractor in the resolution of technical problems encountered during performance.

Within the purview of this authority, the Project Officer is authorized to review all costs requested for reimbursement by contractors and submit reconmendations for approval, disapproval, or suspension for supplies, services required under the contract.

The Contracting Officer is responsible for directing or negotiating any changes in terms, conditions, or amounts cited in the contract.

For guidance from the Project Officer to the contractor to be valid, it must:

(1) be consistent with tne description of work set forth in the contract; (2) not constitute new assignment of work or change to the expressed terms, conuitions or specifications incorporated into this contract; (3) not constitute 3 basis for an extension to the period of performance or contract delivery schedule; and, as stated above, (4) not constitute a basis for any increase in the coatract cost.

ARTICLE X - TRAVEL RElliBURSEl1ENT The contractor will be reimbursed for the following reasonable domestic travel costs incurred directly and specifically in the performance of this contract and accepted by the Contracting Officer:

Per diem shall be reimbursed at a daily rate not to exceed 573.00

The per diem amount is comprised of lodging expense plus $23.00 for meals and miscellaneous expense.

The cost of travel by privately owned automobile shall be reimbursed at the rate of.20c per mile.

The cost of travel by rented automobile shall be reimbursed on a reasonable i

actual expense basis.

4.

All comnon carrier travel reimbursable hereunder shall be via economy class rates when available.

If not available, reimbursement vouchers will be annotated that economy class accommodations were not available.

First-class air travel is not authorized.

Receipts are required for common carrier transportation, lodging and miscellaneous items in excess of 515.00

(a)

It is ihe policy of the United States Government that women-owned businesses shall have the maximum practicable opportunity to participate in the perf ormance of contracts awarded by any federal agency.

(b) The Contractor agrees to use his best efforts to carry out this policy in the award of subcontracts to' the fullest extent consistent with the efficient performance of this contract.

" Control" in this context means exercising the power to make policy decisions.

5.8 Interest on Overdue Payments (a) The Prompt Payment Act, Public Law 97-177 (96 STAT, 85, 31 USC 1801) is applicable to payment of the expirat' ion invoice under this contract and requires the payment to contractors of interest on overdue payment of the expiration. invoice or improperly taken discounts.

(b) Determinations of interest due will be made in accordance with the provisions of the Prompt Payment Act and Office of Management and Budget Circular A-125.

(c)

For purposes of this clause, an expiration invoice is defined as a claim submitted for costs incurred for performance through the expiration date of a Cost Type contract.

5.9 Payment Due Date (a) Payments under this contract will be due on 30 calendar days after the later of:

(1) The date of actual receipt of a proper invoice (original and 4 copies) to the U. S. Nuclear Regulatory Commission, Division of Accounting and Finance, Office of Reoaurce Management, ATTN:

GOV /COM ACCOUNTS SECTION, Washington, DC 20555.

(2) The date the deliverable product (s)/ services perforr.ed are accepted by the Government.

For the purpose of determining the due date for payment and for no other purpose, acceptance will be deemed to occur N/A_ calendar day after the date of delivery of the deliverable product (s)/ services performed in accordance with the terms of the contract.

(c) The date of the check issued in payment shall be considered to be the date payment is made.

5.10 Invoice Requirements Invoices shall be submitted in an original and 4 copies to the U. S. Nuclear Regulatory Commission, Division of Accounting and Finance Office of Resource Management, ATTN:

GOV /COM ACCOUNTS SECTION, Washington, DC 20555. To con-stitute a proper invoice, the invoice must include the following information and/or attached documentation:

t (1) Name of the business concern and invoice date.

(2) Contract number or other authorization for delivery of property or services.

(3) Description price and quantity of property and services actually delivered or rendered.

(4) Shipping and payment items.

(5)

Name (where practicable), title, phone number, and complete mailing address of responsible official to whom payment is to be sent.

(6) Other substantiating documentation or information as required by the contract.-

5.11 Waiver of Facilities Capital Cost of Money (Oct 1980)

The contractor is aware that facilities capital cost of money is an allowable cost but waives the right to claim it under this contract.
