Dear Administrative Judges:

In accordance with the schedule established by the Licensing Board, Tr. 1877, Licensee and the NRC Staff filed proposed findings of fact and conclusions of law on December 23, 1982 and January 10, l

1983, respectively. Both parties analyzed the evidence in this proceeding and demonstrated that the record supports issuance of the requested operating license amendments to permit sleeving of steam generator tubes.

Decade, the sole intervenor in this proceeding, has not filed proposed findings and conclusi6hs as contemplated by the Commission's C301190212 830117  %

S 2.754, and as instructed by the Licensing Board, Tr. 1875-80; Memorandum and Order, October 1,,1982, at 18. Instead, Decade filed on December 30, 1982 a " Statement of Inadequate Record" and did not brief the defined issue in contro-versy in this proceeding.

Accordingly, Licensee respectfully requests the issuance of an initial decision authorizing the requested operating license amendments. Because the NRC Staff is in agreement with the Licensee on the resolution of the matter in controversy, and because Decade has failed to file proposed findings and conclusions, this letter constitutes Licensee's sole post-hearing reply filing pursuant to 10 C.F.R. S 2.754 (a) (3) .
