Dear Sir:

Pursuant to the Freedom of Information Act, 5 U.S.C. 5552, as amended, and 10 CFR Part 9, the Attorney General of the Commonwealth of Massachusetts requests the following documents.

The term " documents" as used herein refers to the original and copy (but not both if identical in every respect) of any printed, written, recorded, transcribed, punched, taped, filmed, photo-graphed or graphic matter in the possession o f or subject to control of the NRC or any Commissioner, employee, agent or attorney thereof, whether sent or received or neither, whether a draft or otherwise, however produced or reproduced, and both sides thereof, including but not limited to, any memorandum, correspondence, letter, affidavit, court paper, transcript, diary, report, study, telegram, table, telex message, record, chart, paper, work paper, graph, index, book, notebook, pamph-let, periodical, tape, data sheet, data processing card, note, notation, minute desk calendar, appointment book, sound '

recording, computer print-out or microfilm.

DOCUMENTS REQUESTED (1) All documents which relate in whole or in part to any generic or site-specific accident consequence analyses for (or l having relevance to) postulated releases from the Seabrook Nuclear Power Station, in Seabrook, New Hampshire, including all documents describing the methodology, assumptions, or results of such analyses. This request covers any generic consequence analyses (since WASH-1400) for PWR-1 to PWR-9 releases, or their equiva-  ;

lents (such as the "rebaselined" accident sequences set forth in '

NUREG-0715).

Director November 5, 1982 Page 2 (2) All documents which relato in whole or in part to the manner in which any of the following factors can or should af fect the sizo or configuration of the plume explosure pathway or ingestion pathway Emergency Planning Zones surrounding any given reactor, or the Seabrook Nuclear Power Station in particular:

a. demography, including the sizo and_ location of seasonal and transient populations;
b. meteorology;
c. topography; -
d. land use characteristics;
c. access routes;
f. local jurisdictional boundaries;
g. release timo and energy characteristics;
h. rolcaso height;
1. radionuclido content of relcano, including -

rolcaso fractions;

j. plume dispersion;
k. deposition velocity;
1. available sheltering and the shiciding factors associated therewith;
m. radiation treatment; i
n. breathing rates;
o. groundwater and soil conditions on-sito and proximity to surface water bodies, and the implications of these factors for travel of radionuclides through a liquid pathway in the event of a reactor, moltdown accident.

(3) All documents which relate in whole or in part to the methods or standards to be used or assumptions to be made in calculating or evaluating evacuation timo estimates or performing or ovaluating evacuation studien, or to evacuation Limo estimates or evacuation studies for the Seabrook vicinity.

(4) All documents which relato in whole or in part to any evacuation Limo estimates which the Conunission or its Staf f has ,

found to be excessive and any actions ordered or taken as a result of that finding.

(5) All documents which relate in whole or in part .to taking protective action (s) (including but not limited to, evacuation, sheltering, and the administration of radioprotectivo drugs) in any area within the circular zono having a 50-mile radius surrounding the site of the Seabrook Nuclear Power Station, including all documents relating to the number,typc, or adequacy of sheltering facilities within that zone, i

o Director November 5, 1982 Page 3 (6) All documents which relate in whole or in part to former, current, or proposed applicant, state, or local emergency plans for the Seabrook Nuclear Power Station, or any part thereof.

(7) All documents which relate in whole or in part to any studies, findings, or conclusions, whether preliminary or final, which have been made by any department or division of the NRC with respect to a safety goal.

(8) All documents which relate in whole or in part to the use, storage, stockpiling, distribution, or conditions for use of potassium iodido or other radioprotective drugs, in general or in the vicinity of the Seabrook Station.

(9) All documents which relate in whole or in part to.

the levels (sometimes called Protective Action Guidelines) of whole body or thyroid exposure to airborne radioactive material or of exposure to radiation via the food pathway which should initiate various protective actions, including all documents which describe the method by which such. exposure levels are set.

(10) All documents which relate in whole or in part to modifications or improvementu which havb*been made to the Reactor Safety Study accident consequence model (the so-called "CRAC Code") since its original development.

(11) All documents which relate in whole or in part to the potential consequences of accide'ntal releases to the liquid pathway as a result of core melt accidents and/or to methods for preventing or mitigLting such consequences, including all documents relating to the consequences of a core melt accident at the Seabrook Station or methods for preventing er mitigating those consequences.

(12) All documents which relate in whole or in part to the medical treatment which will be available to the public in the event of an accident at the Seabrook Station.

(13) All documents which relate in whole or in part to current or projected population figures or distributions within a 50-mile radius of the Seabrook site over the anticipated life of the plant, including transient and seasonal populations.

(14) All documents which relate in whole or in part eo the establishment of emergency action levels, in general or for the Seabrook Station.

e .m Director November 5, 1982 Page 4 In our opinion, it is appropriate in this case for the NRC to waive copying charges, pursuant to 5 U.S.C. S552 (a) (4 ) ( A) and 10 C.F.R. 59.14a "because furnishing the information can be con-sidered as primarily benefitting the general public" and this office is a state agency to whom furnishing the records without charge is an " appropriate courtesy." The Massachusetts Attorney General represents the citizens of Massachusetts in the NRC operating licensing proceeding for the Seabrook Nuclear Power Station (NRC Docket Nos. 50-443, 50-444), and has an immediate interest and duty in ensuring that adequate radiological emer-gency plans can be and are. developed to ensure the protection, health and safety of the citizens of the Commonwealth (see M.G.L.

c.12, SSI et seq.). The Attorney General has an immediate and real interest Tn receiving the documents requested herein in order to adequately prepare for hearings before the Atomic Safety and Licensing Board on the issue of emergency planning.

We understand that under the Freedom of Information Act, you must respond to this request within ten (10) working days, and that your failure to respond within that period of time is considered to be a denial of the request. We suggest that you contact us before actually forwarding documents, as we al re,aQy have certain NRC publications regarding these areas and do' hot wish to prompt unnecessary duplication or mailing.
