During reviews of licensee cases, we occasionally identify license conditions or requirements that can be deleted. Such is the case with the requirements of Material Control and Accounting License Conditien 2.2 which states that, in the absence of specific exemptions or exceptions, you are responsible for all 10 CFR Part 70 requirements irrespective of commitments in the Plan identified in License Condition 2.1.
Given that the referenced Plan should address all regulatory requirements, this license condition is superfluous. This fact has already been recognized in the Physical Security Licensing area which does not have a similar license condition.
Consequently, we are deleting License Condition 2.2 of Amendmeit MPP-1 to your License No. SNM-778, effective imediately.
In connection with this action, you should be aware that you remain obligated to comply with all regulatory requirements. Apparent deficiencies between your approved Plan and the regulations identified by NRC Regional inspection personnel will be referred to Licensing for necessary Plan revisions.
