CONTENTION VI (ALLEGED WITHDRAWAL 0F GENERAL ELECTRIC FROM NUCLEAR HARDWARE MARKET)

It is the position of the NRC Staff that the affidavit provided by Applicant's counsel (Affidavit of W. H. Bruggeman, dated December 13,1982) effectively serves to refute any alleged intention of General Electric Company to withdraw from the nuclear hardware market, which might impact upon future modifications of Clinton Unit 1.

Moreover, the Staff is not independently aware of any information contrary to that presented in the Bruggeman affidavit. Accordingly, the Staff would support withdrawal of this Contention prior to hearing, in order to preclude the unnecessary effort and expense of its litigation.
