We have received copies of two letters dated November 1,1982, that forwarded two topical reports to the Standardization & Special Projects Branch of the Division of Licensing (DL) for review. One letter transmitted Revision 3 to BAW-10092P -
Craft 2-FORTRAN Program for Digital Simulation of a Multinode Reactor Plant during a LOCA. The other letter transmitted BAW-10154P - Bf3 Small Break LOCA.
ECCS Evaluation Model.
Each of your letters stated that it was your understanding that fees pursuant to 10 CFR 170 will not be required for their review since they were prepared in response to an HRC Order, and that the reports are for referencing in future licensing efforts.
The purpose of this letter is to respond to your statement on fees. Under the provisions of Part 170, we do exempt licensees from fees when an application is required as a direct result of an order issued pursuant to 10 CFR 2.204. Based on information provided by the DL staff, it is our understanding that the orders issued were to licensees and not to the licensee's vendors. While applications for license amendments, pursuant to Part 50, by licensees that are as a direct result of an order issued to them are exempt from fees, topicals and other reports and amend-ments or revisions to approved reports are not exempt from fees by virtue of an order issued to another company. Therefore, the subject topical reports are subject to the fee requirements of Part 170 and the fees to be assessed will be determined after the DL staff have completed review of the reports.
