NEW YORK STATE'S MOTION FOR MODIFICATION OF HEARING SCHEDULE By Memorandum and Order of November 16, 1982 the Atomic Safety and Licensing Board set dates for hearings on Commission Questions Three ano Four. Unfortunately the hearing dates set conflict with the exercise scheduled for March 8, 1983. We therefore suggest that the Boaro's Order be modified so that hearings on Commission Questions Three and Four start on March 15, 1982, instead of March 1, 1982.

The Board's Order schedules hearings on Commission Questions Three and Four to begin on March 1, 1982 (pg. 23 of the Board's i Order). Three weeks are allotted for those hearings which are to be held on Tuesdays through Fridays. The exercise to test emergency planning preparedness required by NRC regulations 10 CFR 55 0. 47 (a) (14) is scheduled for March 8, 1982. New York State's 8212070246 821203 PDR ADOCK 05000247 []

2 l witnesses on radiological emergency planning will be engaged in planning for the exercise prior to March 8, 1982. The three days following the March 8, 1982 exercise will be devoted to a review of the exercise. Thus New York State's witnesses cannot appear until the week of March 14th, the last week allotted for hearings.

If New York State was the only party with any conflict then the problem could be resolved by scheduling New York State's witnesses for the week of March 14th. However County personnel responsible for emergency planning will be involved in preparation for participation in an exercise and in the debriefing following participation in an exercise. These County personnnel are the likely witnesses for the Counties on emergency planning. It will be extremely difficult to coorainate the presentation of testimony if a number of important witnesses will be unavailable for a large portion of the time allotted. If the hearing schedule remains unchanged it is conceivable that some persons may be confronted with the choice between not testifying and limiting their participation in, or their observation of, the exercise. Both alternatives would be unacceptable choices.

The best solution to the possible problem of witness unavailability is to postpone hearing testimony on Commission Questions Three and Four until after the exercise and thus commence that portion of the hearings March 14th. This proposal will require that the hearings on Question Five begin one week later in order to give a one-week break after the three weeks allotted for Questions Three and Four. Also, hearings on Question Six should begin one l

3 week later, allowing a one week bret:. after the week allotted for Question Five. If our proposal proves unacceptable to the Board then at the very least more time than one week should be allocated for testimony of the State, Counties and other persons concerned with the exercise on emergency planning issues.

For the reasons stated in this motion, as supported in the attached affidavit, we suggest that the hearing schedule be modified by beginning the hearing of testimony on Questions Three and Four on March 15, 1983.
