NRC STAFF'S MOTION FOR EXTENSION OF TIME TO FILE ANSWEP nPPOSING COMMONWEALTH OF PENNSYLVANIA'S PETITION FOR REVIEW 0F ALAB-698 On December 1,1982, the NRC Staff received a copy of " Licensee's Opposition to Comonwealth of Pennsylva.la's Petition for Review of ALAB-698," dated November 29, 1982, in the captioned proceeding.

Therein, Licensee references, and responds to, a petition for Comission review of ALAB-698 filed by the Comonwealth of Pennsylvania on November 12, 1982. Under 10 CFR I 2.786(b)(3), any responses in opposition to the Commonwealth's petition were due for filing by November 29, 1982.

The NRC Staff was wholly unaware that any such petition had been filed by the Commonwealth until the Staff received the Licensee's i

response to the petition on December 1,1982. The Staff did not receive a copy of the Commonwealth's petition for review until one was forwarded by the Office of the Secretary to Staff counsel on that date.

In view of the fact that the Staff was not aware of, and did not receive the Comonwealth's petition for review until December 1,1982, it was not possible for the Staff to file a response to the petition by

-____ the date prescribed by 10 CFR 5 2.786.

In these circumstances, good cause exists for an extension of the time within which the Staff may file a response in opposition to the Commonwealth's petition.

Accordingly, the Staff respectfully requests an extension of ten days from the date of the Staff's receipt of the Commonwealth's petition on December 1, 1982 to respond to that petition. Staff counsel has been authorized by counsel for the Commonwealth of Pennsylvania to state that the Commonwealth does not oppose this extension requested by the Staff.
