Dear Mr. Denton and Ms. Diggs:

DOCKET NOS. 50-266 AND 50-301 LICENSE AMENDMENT APPLICATION APPROVAL FEES POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 In a letter from Ms. Diggs dated October 29, 1982, the NRC requested Wisconsin Electric to remit a sum of $9,900 as an additional fee for license amendment approvals for our applications for Technical Specification changes dated May 27 and September 30, 1982.

These additional fees were requested because of the Staff's interpretation that the May 27 application requires a Class IV rather than Class III approval and, in the case of the September 30 request, the NRC review will involve consideration of both a single safety issue and an administrative or pro forma change.

You also concluded that, in the latter situation, two rather than one duplicate fee would be required for the second unit.

We have reviewed this interpretation of the fees required and are remitting the specified fees for these applications with the following clarification.

As discussed in a letter to Mr. Denton dated January 13, 1981, a single license amendment application which encompasses two or mqre classes of license amendment apprpnalsw'ould -

require only one Class I, or duplicate, license approval for the second unit since Point Beach Units 1 and 2 share common Technical Specifi-cations.

This interpretation was concurred with in Mr. W. O. Miller's letter to licensee dated September 2, 1981.

Accordingly, with respect to the September 30, 1982 license amendment application, a single Class I, or duplicate, fee remains appropriate.

We have, therefore, enclosed herewith a check drawn in the amount of $9,500 to complete our payment of fees in these matters.
