This is in further response to your letter dated September 16, 1982, in which you requested, pursuant to the Freedom of Information Act, three separate categories of documents regarding shipments of waste through Vermont from Chalk River.
The documents listed o. Appendix A are responsive to your request.
Documents 1 and 2 are released in their entirety.
Documents 3, 4, and 5 contain unclassified safeguards information. The statutory authority-for withholding this information is found in Section 147 of the Atomic Energy Act (42 U.S.C. 2167). This information is being withheld from public disclosure pursuant to exemption (3) of the Freedom of Information Act (5 U.S.C. 552(b)(3)) and 10 CFR 9.5(a)(3) of the Commission's regulations.
Copies of the non-exempt portions of these documents are enclosed.
Pursuant to 10 CFR 9.9 of the Conmission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the undersigned and Mr. John G. Davis, Director, Office of Nuclear Material Safety and Safeguards.
This denial may be appealed to the Connission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Connission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
The search for additional documents r,ubject to your request is continuing.

The Nuclear Assurance Corporation (NAC), as agent for Atomic Energy of Canada, Limited (AECL), plans to make a series of spent fuel shipments from an AECL facility at Chalk River to the U.S. DOE Savannah River Plant. These shipments would enter the U.S. at Alexandria Bay, New York, under NAC's Import License No. ISNM81005, Revision 1, and would continue until the material described by the license has been shipped or the shipments are delayed for reason.
The schedule for these shipments is enclosed.
Adjustments to the schecole will be made in writing if time permits, and by telephone (followed by letter) if necessary.
This notification is made in accordance with the requirements of 10 CFR 73.72.

Dear Sir:
On July 2,1982, the Nuclear Assurance Corporation sent to you a letter making pre-notification of a planned series of irradiated reactor fuel shipments from the Chalk River Facility of Atomic Energy of Canada, Ltd., to the U.S. Savannah River Plant.
In our letter we incorrectly identified the port of entry as Alexandria Bay, New York.
The correct port of entry is Derby Line, Verment.
In addition, we have revised the estimated time of entry.
This change in indicated in the separately enclosed schedule inforriation sheet.
We regret this error.
This letter confirms verbal notification of these changes made on this date to the addressees.
