,u usually controlled by industrial or other business organizations to protect h
tr,cir competitive positions in the market place and frequently is received

by the'Cor. mission from vendors and utilities in the safety review of appli-D cations for licenses to construct or operate comercial nuclear power plants.

Sone persons have maintained that where proprietary inforir,ation con-r;@
tains important information about the safety aspects of the design and M
[
operation of nuclear pcwer plants and other nuclear facilities and that V
where a decision to license such a facility is based, in part, on such y
'j inforration, it should be disclosed to the public. Others maintain that t
- :f protection of proprietary information provides an incentive for making
- ?$l additional improvements in technology which would fi rther enhance the safe-
[i ty of these facilities.
Under the present regulations, most NRC records and documents in
- j; licensing proceedings are routinely made available to the public. However, yv the regulat.~on, which is consistent with the Freedom of Information Act, provides for some exceptions to this general policy; disclosure of" proprietary infor=ation is one of these exceptions."
In November of 1973, the former Atomic Energy Comission announced

that it was considering changes in its policy and regulation dealing with
