ORDER On July 20, 1982 the Atomic Safety and Licensing Board 1ssued a Partial Initial Decision (PID) covering the seismic issues in controversy in this proceeding.

The Board found, subject to certain conditions, that the plant's design is adequate to protect public health and safety.

The Board on August 4, 1982 issued a Supplemental PID covering the remaining issues in controversy and authorizing the Director of Nuclear Reactor Regulation to issue an operating license for the Virgil C. Summer Nuclear Station,' Unit 1, subject to the seismic conditiohs and certain other conditions regarding, e.g',

emergency preparedness.

The Commission has now completed its review to determine whether the Board's decisions should become 8211150416' 821110 PDR ADOCK 05000395 MoA

2 effective.

10 CFR 2.764(f).

The Commission has decided to make the decisions effective.

Since the Commission's decision to make the Licensing Board's decisions immediately I

effective deals only with matters in controversy before the Board, however, and not with uncontested issues which are considered separately by the staff and the Commission, this order does not authorize the issuance of the requested full-power licenses.

Such licenses will not be issued until the staff has briefed the Commission on the remaining issues and the Commission has determined whether to authorize the licenses.

Commissioner Gilinsky abstained from this decision.

It is so ORDERED.
