Dear Mr. Martin:

By letter dated August 2, 1982, the Authority responded to Appendix A of the subject report which identified a violation of the Fire Brigade Require-ments of Section III.I Appendix R to 10CFR50 and the Nuclear Regulatory Commission Supplemental Safety Evaluation Report (SER) dated May 2, 1980. The Authority's reply stated, that Section III.I of Appendix R did not apply to the Indian Point Unit 3 facility and that the requirements for Fire Brigade Training, as approved by Section 2.5.2 of the May 2, 1980 SER and interpreted by the Authority, had been fulfilled.

During subsequent telephone conversations with Mr. Harry Kister of your office, the Authority was informed that Region I personnel did not agree with the Authority's interpretation of Section 2.5.2. Our disagreement on the interpretation of Section 2.5.2 remains but our interest in providing adequate training for the fire brigade is common and not in dispute. Consequently I proposed the following modification to our Fire Brigade Training Program.

Effective October 1, 1982, all members of the Indian Point Unit 3 permanent Fire Brigade will have participated in at least one drill. No later than

. April 1, 1983 all permanent Fire Brigade members will have participated in at least two drills and will continue to participate in a minimum of two drills per year. Annually Fire Brigade members will participate in training sessions in cetual fire extinguishment. This program was found to be mutually acceptable.
