November 4, 1982 ORDER SCHEDULING IN CAMERA EVIDENTIARY HEARING fpplicant Long Island Lighting Co. (hereinafter "LILC0"), and Intervenor Suffolk County (hereinafter "the County"), have been negotiating a settlement of the. issues in this security proceeding. On October 15,1982 LILC0 and the County stated that they had reached an

" Agreement in Principle." On October 8,1982 the " Joint Status Report of the Parties" stated that "The final agreement will be filed with the l

Board on or before November 1."

On November 1,1982 counsel for the County advised the Board that a final agreement had not yet been executed.

In order to avoid delay in the licensing process, the Board believes that a hearing on the merits should be scheduled.

In the event that a final agreement of all parties is achieved prior to that time, that agreement will be discussed and reviewed at the hearing.

In the event that no final agreement is achieved, the in camera evidentiary hearing will commence at that time.

.- WHEREFORE IT IS ORDERED this 4th day of November that this matter will come on for an in camera evidentiary hearing on the merits or an evaluation of the final agreement of settlement beginning on Monday, December 13,1982 at 9:30 a.m.

at the Nuclear Regulatory Connission Hearing Room located at 4350 East-West Highway, Fifth Floor, Bethesda, Maryland.

IT IS FURTHER ORDERED that all parties herein shall file, so that the Board will receive such documents on or before the dates listed herein, the following:

1.

On November 24, 1982:

a.

A final agreement constituting a full and complete settlement of the County's nine security contentions, if such agreement exists.

If such final agreement is filed, the parties may disregard all of the following requirements.

b.

A stipulation concerning a revised security contention seven pursuant to Memorandum and Order of this Board dated September 16, 1982.

c.

A stipulation concerning the order of procedure at the hearing, a witness list in the order in which witnesses will be called to testify, and any additions, deletions or amendments to the previously filed testimony.

On December 1, 1982 motions to strike the prefiled direct l

testimony.

On December 8, 1982 answers to the motions to strike.

4.

On December 13, 1982 cross-examination plans consisting of the objectives of the cross-examination, the affirmative evidence the cross-examiner intends to establish by the cross-examination, and the direct testimony which the cross-examiner intends to discredit. These cross-examination plans need not be served on the other parties.
