Dear Senator Riegle:
Your letter of September 13, 1982 to the Connission's Office of Congressional Affairs has been forwarded to me for response. You asked that the Commission provide a thorough and expeditious review of the request by the Board of Commissioners of Monroe County, Michigan to appear before the Atomic Safety and Licensing Board appointed to the adjudicatory proceeding concerning the pending application by Detroit Edison Company for an operating license for the Enrico Fermi Atomic Power Plant, Unit 2.
The petition to intervene of Monroe County is presently under consideration by the Atomic Safety and Licensing Board. As provided by the Commission's Rule of Practice, the NRC Staff has filed a response to the Monroe County petition with the Atomic Safety and Licensing Board, as has Detroit Edison Company.
For your information, I am enclosing copies of these responses to the petition which will explain the history of the adjudicatory proceeding regarding the operating license application, as well as the legal and practical considerations regarding the concerns presented in the Monroe County petition.
The Atomic Safety and Licensing Board will review the requests set out in the County's petition and the responses to the petition; and will then issue an Order granting or denying the petition.
I shall forward a copy of the Board's decision to you as soon as it is issued.
I can assure you that the County's petition is receiving careful attention by the NRC. Additionally, the NRC has provided a copy of the County's petition to FEMA.
